06-14-2006 PLANNING AND ZONING MINUTES June 14, 2006 The Schertz Planning and Zoning Commission convened on June 14, 2006 at 6:30 p.m. at the Municipal Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas. CALL TO ORDER/ROLL CALL Mr. Richmond called the meeting to order at 6:44 P.M. (Following a meeting of the Capital Recovery Review Board. ) 2. CITIZEN COMMENTS There was no one to speak. 3. CONSENT AGENDA: Mr. Evans requested Consent Agenda Items 3A, 3E and 3F be pulled for separate discussion. Mr. Richmond requested Consent Agenda Item 3G be pulled for separate discussion. Mr. Van Dine requested Consent Agenda Item 3H be pulled for separate discussion. B. PC2006-0S0 Consider and act upon a request for a final plat of the Fairway Ridge Subdivision, Unit 2. The IS.004j: acre tract consists of 63 residential lots generally located at the northeast corner of FM 1103 and Chelsea Drive. The property is zoned Residential-7 District (R-7). Applicant: Carlos SandovallJMLG Holdings, Ltd. C. PC2006-040 Consider and act upon a request for a preliminary plat of Kramer Farm Subdivision, Unit 2. The 13.207j: acre tract consists of 73 residential lots generally located at intersection of Kramer Parkway and Schertz Parkway The property is zoned Residential-S (R-S). The 5.21:t acre tract is located on Live Oak Road approximately 1,400 feet Southwest of FM-3009. The property is zoned Public Use District (PUB). Applicant: City of Schertz I. PC2006-049 Consider and act upon a request for preliminary plat of Enterprise Park Subdivision. The 125.79:t acre tract is located at Associate Drive, Northeast of Lookout Road. The property is zoned Manufacturing District-Light (M-l). Applicant: Tedford Barklay, Trammell Crow Following reading of the Consent Agenda items, Mr. Wallace moved to approve Consent Agenda Items 3B, 3C, 3D and 31. Mr. Richmond seconded the motion. Motion carried. Vote unanimous. Staff comments, attached herewith and made part of these minutes, include a recommendation of approval. A. Consider and act upon the minutes of the September 27, 2005 Planning and Zoning Work Session meeting and the November 8, 2005, April 12, 2006 and May 10, 2006 Regular Planning and Zoning meetings. Mr. Evans noted that in the minutes for the meeting on November 8, 2005, the letter F. was omitted from the Consent Agenda List. Following review and discussion, Mr. Wallace moved to approve the minutes with the noted corrections. Mr. Van Dine seconded the motion. Vote unanimous. E. PC2006-047 Consider and act upon a request for a preliminary plat of Kramer Farm Commercial Subdivision. The 1. 765-acre tract is located at intersection of Kramer Parkway and Schertz Parkway The property is zoned Residential-2 (R-2). Applicant: JWD Management Corporation Ms. Nichols reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. After a brief discussion, Mr. Aiken withdrew his application and asked to have item placed on the next agenda. F. PC2006-048 Consider and act upon a request for an Amending Plat of the Mesa Oaks Subdivision. The 1.52:t- acre tract is located at the intersection of Oak Run and Oak Park. The property is zoned Residential-6 (R-6). Applicant: Burkett Live Oak Ltd. Mr. Evans asked for an explanation concerning the 2-foot common fence line. Mr. Aiken explained to the commission that the 2-foot fence line has been added as a buffer to the adjacent development. Following review and discussion, Mr. Van Dine moved to approve this item. Ms. Tutschke seconded the motion. Motion carried. Vote unanimous. G. PC2006-053 Consider and act upon a request for preliminary plat of the Mesa Oaks II Subdivision. The 19.936:t- acre tract consisting of 79 residential lots is generally located at the intersection of Maske Road and Live Oak Road. The property is zoned Residential-6 (R-6). Applicant: Burkett Live Oak, Ltd. Ms. Nichols reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. Mr. Evans asked if additional right-of-way would be required for Live Oak Road. Staff explained that the Master Thoroughfare Plan indicates that Live Oak Road is intended for a 60-foot right-of-way. No dedication would be required. Following review and discussion, Ms. Tutschke moved to approve this item. Mr. Van Dine seconded the motion. Motion carried. Vote unanimous. H. PC2006-044 Consider and act upon a request for preliminary plat of Laura Heights Subdivision, Unit 2. The 24.201:t acre tract contains 40 Single-Family lots located at the intersection of Ware-Seguin Road and Boenig Drive. The property is zoned Residential-Agriculture (RIA). Applicant: H.L.H. Development, L.P. Ms. Nichols reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. Mr. Van Dine stated that Ms. Nichols addressed his questions in the staff comment. Following review and discussion, Ms. Tutschke moved to approve this item. Mr. Van Dine seconded the motion. Motion carried. Vote unanimous. 4. PUBLIC HEARINGS: There are no items for public hearings. 5. ITEMS FOR INDIVIDUAL CONSIDERATION: A. PC2006-045 Consider and act upon a request for site plan of Block 2, Lot 14 of the Schertz Industrial Park Subdivision. The 1.47:t-acre tract is generally located at the southwest corner of FM-3009 and Bell North Drive. The property is zoned Manufacturing-Light (M-l). Following review and discussion, Mr. Van Dine moved to table the request until the June 28, 2006 Planning and Zoning meeting, due to no representative being present at the meeting. Mr. Wallace seconded the motion. Voting Aye: Ms. Tutschke, Mr. Van Dine, Mr. Wallace, Mr. Richmond and Mr. Evans. Voting Nay: Mr. Sommers. Motion carried. B. PC2006-0S1 Consider and act upon a request for site plan of the FM-3009 Retail Subdivision. The 3.69S:t -acre tract is generally located at the northeast corner of FM-3009 and Four Oaks Lane. The property is zoned Manufacturing-Light (M-l). Applicant: Cencor Acquisitions Company Ms. Nichols reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. Following review and discussion, Mr. Sommers moved to approve the request contingent on: 1. the lighting that conforms with the UDC 2. substitute for the Texas Sycamore Trees Mr. Van Dine seconded the motion. Voting Aye: Ms. Tutschke, Mr. Sommers, Mr. Van Dine, Mr. Wallace and Mr. Richmond. Voting Nay: Mr. Evans. Motion carried. C. PC2006-042 Consider and act upon a request for a final plat of WHHT Development. The 8S.94:t acre tract is generally located on the east side of FM 3009 between the Union Pacific Railroad tracks. The property is zoned Manufacture District-Light (M-l). Applicant: Hardin Herald & Company, LLP Item was withdrawn by applicant prior to the meeting. D. ZC2005-016 Consider and act upon amending the City of Schertz Unified Development Code, Article III (Zoning Districts), Article IV (Permissible Uses) and Article VI (Density and Dimensional Requirements). Applicant: City of Schertz. (This item was tabled at the S/24/06 Planning and Zoning meeting.) Mr. Sommers moved to remove this item from the table. Mr. Wallace seconded the motion. Motion carried. Vote unanimous. Ms. Ellis reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. Following review and discussion, Mr. Wallace moved to forward this item with a recommendation of approval to City Council contingent on the correction ofthe typographical error located on Table VI-A, the Townhome District - Maximum Height should read 35-feet not 25-feet. Discussion regarding proposed zoning map and public hearing procedures. Ms. Ellis reviewed the proposed Zoning Map with the commissioners and it will be placed on the July 26th, 2006 Planning and Zoning Meeting agenda for public hearing. 6. ITEMS FOR DISCUSSION A. City Council Mr. Carpenter sat in for Mr. Wilenchik due to illness. Mr. Carpenter did not have a formal report other than he will be sworn in as Mayor Pro Tern at next council meeting. Mr. Carpenter will continue to substitute for Mr. Wilenchik. Mr. Carpenter thanked the Commissioners for their work on the Planning and Zoning Commission. B. Director's Report Ms. Nichols notified the Commission of the APA Conference in Corpus Christi starting on October 18th, 2006, and asked each commissioner to check their calendars for availability to attend. Mr. Truitt welcomed Chris Gabbard as the new Planner. C. Planning Commissioner Comments Ms. Tutschke: Stated that she will attend the AP A Conference this year. Mr. Sommers: HEB is becoming a lemon lot for cars again. Mr. Van Dine: In reference to the Zoning Map - R.E. is welcomed to the south of town. Mr. Evans: Asked about Mr. Grant, if anyone has heard from him. Mr. Wallace: In reference to lighting, ifthe item is required it should be on the plat, or change the requirement for it to be shown on the plat. Mr. Richmond: Congratulations to Leonard on becoming the Director of Development Services. He noted that Ms. Madison's gain is the Planning & Zoning Commissions' loss on Ms. Ellis moving to Economic Development. He commented on an article from the Neighbors section of the June 7th Express News paper regarding the IHlO corridor. At the last City Council meeting there was discussion on the tree islands in the Arroyo Verde Subdivision and how they are creating traffic issues. City Council determined that "No Parking Signs" would be installed at each island. Mr. Evans: Over time the request for TIA information data is outdated. It does not account for the number of cars in driveways; residents need to get vehicles off the street. 7.
