06-28-2006PLANNING AND ZONING MINUTES June 28, 2006 The Schertz Planning and Zoning Commission convened on June 28, 2006 at 6:30 p.m. at the Municipal Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas. CITIZEN COMMENTS Amy Madison, Executive Director of the Economic Development Department, spoke about TxDOT's approval on Texas Highway 130. 3. CONSENT AGENDA: A. PC2006-046 Consider and act upon a request for a final plat of the Riata Subdivision, Unit 1. The 32.774 acre tract contains 130 residential lots, generally located between IH-35 and Old Wiederstein Road. The property is zoned Residential Distict-7 (R-7) Applicant: Riata Land, Ltd. Following reading of the Consent Agenda items, Mr. Van Dine moved to approve the Consent Agenda item. Ms. Tutschke seconded the motion. Motion carried. Vote unanimous. 4. PUBLIC HEARINGS: Minutes Planning and Zoning Commission June 28, 2006 Page 1 of 5 A. ZC2006-008 Hold a public hearing and consider and act upon a request to rezone 13.9721 acres from Residential District-1 (R-1) to Residential District-7 (R-7). The tract is situated out of the Torribo Herrera No.68 Survey, Abstract No.153, Guadalupe County, Schertz, Texas. The property is generally located at the east of Schertz Parkway at Macke Road. Applicant: Harry Jewett and Associates Ms. Nichols reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. There were thirty-seven letters mailed with no responses. The City Council will hold a public hearing on July 18, 2006. Mr. Thorn stated that he is against the proposed development because it will have connectivity between the two subdivisions and cause more traffic related problems on Cotton King. Mr. MacDonald stated that he is also against the proposed development because it will have connectivity between the two subdivisions and open up Cotton King. He does not want added traffic on Cotton King; the traffic is bad enough now on Cotton King. Mr. Cook stated that he has no problems with the proposed development. He wants Cotton King open to be able to connect to Live Oak Road. Mr. Perry stated that he is against the proposed development because he does not want to see more windowless homes, that there are already enough windowless homes along Schertz Parkway. Mr. Brown stated that he does not want to see property go to smaller lots. He is also very concerned about the traffic issues, and creating more traffic issues on Woodland Oaks by connecting the two subdivisions. Ms. Trommer stated that she is opposed to the proposed development. She is concerned about opening up Cotton King, she feels that by opening up Cotton King it will cause additional traffic. She is also concerned about the safety of kids in the neighborhood. Mr. Kochart stated that he is opposed to the proposed development, saying that it will cause more traffic problems. Mr. Ackermann stated that he is in favor of the proposed development. He stated that he didn't say anything when the people around him moved in. He also stated that if the homeowners didn't like it they could buy his property. Public Hearing Closed at 6:57 pm. Mr. Wallace commented that the biggest complaint he receives from citizens is the lack of connectivity between subdivisions. Also commented that this is a zoning issue only. Mr. Richmond commented that the citizens are concerned only about the new homes being built around them and not that the zoning is changing, and that is what this item is about. With no further discussion, Mr. Wallace moved to recommend approval to the City Council. Mr. Van Dine seconded the motion. Vote unanimous. Motion carried. ZC2006-007 Hold a public hearing and consider and act upon a request to rezone 1.765E acres from Residential District-2 (R-2) to Neighborhood Services (NS). The tract is situated out of the G. Malpaz No.67 Survey, Abstract No.221, Guadalupe County, Schertz, Texas. The property is generally located at the intersection of Schertz Parkway and Kramer Parkway. Applicant: JWD Management Corporation Ms. Nichols reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. There were 5 letters mailed with one return to sender and 1 opposed. The City Council will hold a public hearing on July 18, 2006. Mr. McCrary spoke about this being the final stage of the Kramer Farm Subdivision and the building will be used for professional offices. There were no citizens to speak on this item. Public Hearing Closed at 7:09 pm. Mr. Evans is concerned about the flood plain and FEMA. Ms. Nichols commented that staff has not heard from FEMA in regards to this item. Mr. Richmond expressed his concerns on moving forward with out knowing what FEMA is doing. With no further discussion, Mr. Van Dine moved to recommend approval to the City Council. Ms. Tutschke seconded the motion. Vote unanimous. Motion carried. 5. ITEMS FOR INDIVIDUAL CONSIDERATION: A. PC2006-058 Consider and act upon a request for a preliminary plat with variance and replat of the Belmont Park, Unit 7. The 11.93E acre tract is generally located off IH-35, northeast of the Freeway Manor Subdivision, containing 48 residential lots. The property is zoned Residential District-5 (R-5). Applicant: Continental Homes of Texas, L.P. (aka: D.R. Horton) Ms. Nichols reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. Following review and discussion, Mr. Wallace moved to approve this item. Mr. Van Dine seconded the motion. Vote unanimous. Motion carried. B. PC2006-047 Consider and act upon a request for a preliminary plat of Kramer Farm Commercial Subdivision. The 1.765+_ acre tract is located at intersection of Kramer Parkway and Schertz Parkway. PC2006-045 Consider and act upon a request for site plan of Block 2, Lot 14 of the Schertz Industrial Park Subdivision. The 1.47±-acre tract is generally located at the southwest corner of FM-3009 and Bell North Drive. The property is zoned Manufacturing-Light (M-1). (This item was tabled at the June 14, 2006 meeting) Applicant: BHH Properties Ms. Nichols reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. Before review and discussion, Mr. Wallace moved to un-table this item. Ms. Tutschke seconded the motion. Following review and discussion, Mr. Van Dine moved to approve this item. Mr. Sommers seconded the motion. Vote Aye: Ms. Tutschke, Mr. Van Dine, Mr. Wallace, and Mr. Evans. Vote Nay: Mr. Richmond. Motion carried. 6. ITEMS FOR DISCUSSION A. City Council Mr. Carpenter commented about Jonette Ellis' presentation of the zoning map to the City Council and that it is on schedule and continuing to move forward. He also commented that the City Attorney discovered that the State Legislature passed the Sedona MUD. City Council decided to go a different route and it was never pulled from legislation. City Council will consider dissolving the MUD so that there are no conflicts. When that is done Mr. Carpenter will report back to the Commission. B. Director's Report Mr. Truitt reported that he will be on vacation until July 7, 2006 and if there are any problems or questions to please forward them to Misty Nichols. C. Planning Commissioner Comments Ms. Tutschke: Nothing. Mr. Sommers: Will be on vacation July 7~' through July 14~' and will not be taking his cell phone. He will not be attending the July 12~' meeting. Mr. Van Dine: Commented about the growth along IH10 frontage and the properties that are coming up for sale. He also added that his property came up for sale. Mr. Evans: Discussed Ms. Madison's presentation. Minutes Planning and Zoning Commission June 28, 2006 Page 4 of 5 Mr. Wallace: Nothing. Mr. Richmond: Welcomed Ms. Madison's presentation. Ms. Ellis did a great job presenting the zoning map to City Council. 7.
