04-09-2002Planning and Zoning Minutes April 9, 2002 The Schertz Planning and Zoning Commission convened in regular session on April 9, 2002 at 7:OOpm in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. PLANNING & ZONING COMMISSION Ernie Evans, Vice-Chair Ken Greenwald, ex-officio Tony Moreno William Sommers Gary Wallace Keith Van Dine Joyce Briscoe COMMISSIONERS ABSENT David Richmond, Chairman CITY STAFF Ron Youngblood, City Planner Misty Nichols, Recording Secretary OTHERS PRESENT Jack Martin, 5804 St. Andrews Robert Brockman, 4505 Grand Forest Clovis Haddock, 3900 Pecan St. Rhonda Jahns, 5808 St. Andrews Bob & Davene Lee, 5812 St Andrews #1 Call to Order: Vice-Chairman Evans called the meeting to order at 7:OOpm. #2 Approval of Minutes: Mr. Moreno moved to approve the minutes of the regular session of February 26, 2002; Mr. Sommers seconded. Motion passed. Mr. Wallace abstained. Ms. Briscoe moved to approve the minutes of the regular session of March 12, 2002; Mr. Sommers seconded. Motion passed. Mr. Wallace abstained. #3 Status of Final Plats: There were none. #4 BOA Actions: Vice-Chairman Evans stated the BOA actions for Plantation Homes, Mr. & Mrs. McClain, Mr. & Mrs. Cornish, and Mr. & Mrs. Canales are set for a public hearing with the Board of Adjustment on April 15, 2002. At this time Vice-Chairman Evans stated he would move to agenda item #7 since he noticed there were a number of people who signed up for this item. #7 Citizens' Input Other Than Agenda Items: On the subject of the new development of The Fairways of Scenic Hills, Mr. Martin stated that cutting a road and eliminating a cul-de-sac on St. Andrews is an issue with St, Andrews' residents. The developer tore down the Oleanders and other landscaping that had been tended for years. If a road is cut, traffic will cause a large problem for children who previously were able to play in the cul-de-sac. At the time he purchased .his home many years ago he was told the cul-de-sac would never be removed. The citizens have been.. told that the proposal has been approved. Ms. Jahns is concerned for her children who presently play in the street because one of the golf course holes sits in her back yard. In November of 2000 the plans were to have Pebble Beach back up to St. Andrews Street with another cul-de-sac. When the developer changed his mind and decided to make this a through street, Ms. Jahns believes the 4 homeowners affected should have been notified prior to a final decision being made. Mr. Lee stated this street would be a main entrance into the subdivision of some fifty homes when there is already another entrance to the new subdivision nearby. Mr. Evans stated the developers of this property presented to the Commissioners a replat of the proposed subdivision. He then explained to the residents that a public notice is required only for zoning issues and a replat does not concern zoning. Ms. Jahns stated that Ashley Place Unit 1 has only one entrance/exit to the. subdivision. Mr. Evans explained that this subdivision was developed before all Schertz subdivisions required two accesses. Mr. Youngblood then stated that he heard the developer is planning to update the exteriors of the existing homes. Mr. Brockman stated that another option might be for the citizens to take the developer to court and fight for what they want. Mr. Evans agreed this is a possibility although it may be quite expensive and the residents may not get what they are asking for. The residents thanked the Commissioners for their time and input and will speak with the developer. Mr. Evans then presented to the Commissioners a development proposal from Larry Aiken and Don McCrary for Jonas Woods Unit 2 to save as many heritage trees as possible, and also to give emergency vehicles access to the neighborhood which will not have standard 30-foot streets. Mr. Aiken explained that any trees removed for driveways, etc. will be transplanted elsewhere. Mr. Sommers stated that Councilmember Norma Head would be interested in transplanting. trees at the Playscape. Mr. Aiken stated there are so many trees in Units 3 and 4 that some may be transplanted at area parks and schools. So far, transplanting has been effective. In The Village of Jonas Woods, there were 240 to 260 trees transplanted and only 18 of them died. Mr. Aiken stated he would set up a meeting with the Fire Marshall to get plan approval. He asked the Commissioners if he could submit a preliminary and final plat at the next Planning and Zoning meeting. Mr. Evans stated he must meet the published deadline for submission to staff. Mr. Wallace and Ms. Briscoe indicated that if the staff approves this proposal, they have no problems and would like to see as many trees as possible saved. #5 Discussion: On an Annexation strategy. Mr. Youngblood stated that other than Northcliffe the City has not annexed in several years.. He explained to the Commissioners that he and Mr. Evans have met with the Chairman of the Planning and Zoning Commission for the City of Garden Ridge. They discussed a possible agreement to take our City limits to the south side of FM 2252 by trading our property on the north side of FM 2252 to Garden Ridge. Mr. Evans stated that common sense should apply to extending our City boundaries and he will work with Mr. Youngblood to revise the Annexation Plan. Mr. Youngblood stated the areas to look at for possible annexation first are: • Square up Eckhart Rd with FM 1103. • Bring in Rittiman Addition at FM1518. • Square up the area around FM 2252. #6 Discussion: On potential Zoning & Re-Zoning of areas in the City. Mr. Youngblood stated since the City just annexed Northcliffe and Scenic Hills everything is zoned PD (pre-development). R-5 housing has already been approved for this area. Also there is a proposal for a zoning of R- 4 (multi family) in the area near IH35 and FM1103 on our next agenda. Mr. Youngblood explained that after annexation of the three blank areas West of IH35, the zoning should be R/A (residential/agriculture). After a brief discussion of how this may affect the residents, it was decided this would not be a good idea. The 73-acre piece of property recently purchased by the City for drainage improvement needs to be zoned, and much is available for parks, ball fields, etc. Also, rezoning property from FM1518 towards IH10 for businesses and an industrial park should be considered. #8 Items by Commissioners and City Planner: Gary Wallace: none Ernie Evans: Newsletter states there will be an open house safety meeting from 8:30am to 5:OOpm tomorrow in the Inspections Department.
