05-24-2006PLANNING AND ZONING MINUTES May 24, 2006 The Schertz Planning and Zoning Commission convened on May 24, 2006 at 6:30 p.m. at the Municipal Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas. Citizen Comments Mr. Brockman informed the Commissioners that the sun sets and glares through the Council Chambers into the Commissioners eyes. 3. CONSENT AGENDA: There were no items on the consent Agenda. 4. PUBLIC HEARINGS: A. SUP2006-002 Hold a public hearing and consider and act upon a request for a Specific Use Permit to allow a single family residential home to be located in the Air Installation Compatible Use Zone (AICUZ). The 24.128± acre tract is situated in the Stacey B. Lewis Survey No. 317, Abstract No. 433, County Block 5068, Bexar County, Schertz, Texas. The property is located at 11060 Ware Seguin Road. The property is zoned Residential/Agricultural (R-A). Applicant: Frederick and Patti Steward Ms. Ellis reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. Chairman Richmond closed the public hearing. Following review and discussion Mr. Wallace moved to forward a reconunendation of approval to City Council for this item; Mr. Sommers seconded the motion. Vote unanimous. Motion carried. B. ZC2006-004 Hold a public hearing and consider and act upon a request to rezone 5.13± acres from Pre- Development (PD) to Apartment/Multi-Family Dwelling District (R-4). The tract is situated out of the Rafael Garza Survey No. 98, Guadalupe County, Schertz, Texas. The property is generally located at the southwest corner of Country Club Blvd. and Portage Lane. Applicant: Robert D. Wieder Ms. Ellis reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of disapproval. Thirty-four notices were sent. The Planning and Zoning Department received twelve reply letters in opposition and zero letters on favor of the request. Surrounding property owners and citizens voiced their opinion in opposition of the request. The applicants proposed their development to the Commissioners explained their theory to why this is the best use for the property. Chairman Riclunond closed the public hearing. Following review and discussion Mr. Sommers moved to forward a recommendation of disapproval to City Council for this item; Mr. Van Dine seconded the motion. Motion carried. Vote unanimous. C. ZC2005-016 Hold a public hearing and consider and act upon amending the City of Schertz Unified Development Code, Article III (Zoning Districts), Article IV (Permissible Uses) and Article VI (Density and Dimensional Requirements). Applicant: City of Schertz. Ms. Ellis reviewed staff comments, attached herewith and made part of these minutes, which include a recommendation of approval. Citizens and property owners approached the Commissioners with their questions and concerns. Chairman Richmond closed the public hearing. Following review and discussion Mr. Sommers moved to table a recommendation to City Council until the next meeting; Mr. Van Dine seconded the motion. Motion carried. Vote unanimous. 5. City Council Mr. Wilenchik stated that he had to leave early he had another meeting at 8:00 p.m. to attend. B. Director's Report Mr. Truitt stated that there was nothing to announce at this time. C. Planning Commissioner Comments Mr. Sommers: Stated that the Board of Adjustment disapproved Washington Mutual Bank for an additional sign on the Drive through on the building. Mr. Van Dine: Stated that he noticed that there were three Schertz vehicles on Ware Seguin Road the other day and asked Mr. Truitt what the city was working on. Mr. Truitt stated that he would look into the matter. Mr. Richmond: Stated he understands that the Board of Adjustment has new powers and their consistency is most important. He also mentioned that Arroyo Verde has issues with the islands on the right-of--way. City Councils discussed the options of removing the islands or add signage. 7.
