July 29, 1996
The Schertz Board of Adjustment convened in regular session on
Monday, July 29, 1996 at 6:00 p.m. in the Municipal Complex
Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those
present were as follows:

Chairman Hartzog called the meeting to order at 6:04 p.m.
#2 APPROVAL OF MINUTES: Regular Session July 1, 1996.
Chairman Hartzog asked if there were any questions or
corrections on the minutes.
Ted Duigon moved to approve the minutes for the regular session
July 1, 1996. Anita Clark seconded the motion which carried
with a unanimous vote.
#3 PUBLIC HEARING: The Board of Adjustment to receive
citizen input on a request from Jeffrey Crouch, 410 Aero Ave.,
for a Special Exception to the Zoning Ordinance for a front
yard setback of 4'6" to construct a covered porch. (BOA
#75-96)
Jeffrey Crouch was at the meeting to represent this request.
Chairman Hartzog stated the purpose of the Public Hearing is to
receive comments from interested citizens. The Board of
Adjustment will take all of the comments into consideration on
their decision. After the Public Hearing is closed there will
be no other comments taken.
Chairman Hartzog asked for staff input.
Steve Simonson stated in accordance with the ordinance for the
Board of Adjustment, all property owners within a 300 foot
radius were notified. There were 43 letters sent concerning
this request, 11 were received back: all were in favor of this
request for variance.
Jeffrey Crouch stated he was made aware of the guidelines on
why someone has to go through this process during the Planning
and Zoning Commission meeting. This request will not propose
any type of safety hazard as it is only going out 8'.
Chairman Earl Hartzog asked if there was a tree in the front
that would have to be removed. Jeffrey Crouch stated there is
no tree in the proposed expansion.
Joyce Briscoe asked why the Planning and Zoning Commission
didn't recommend this request to the BOA like they normally do?
Ernie Evans stated there was a recommendation but the way it
was said in the motion was the way it has to be presented to
the BOA by the Planning and Zoning Commission. The request did
pass with all of the Commissioners in favor.
Chairman Hartzog closed the Public Hearing at 6:09 p.m. with
no other comments or questions.
#4 CONSIDER AND TAKE APPROPRIATE ACTION: Consider and
take action on the Special Exception request from Jeffrey
Crouch. (BOA #75-96)
Joyce Briscoe moved to approve the request from Jeffrey Crouch,
410 Aero Ave. for a Special Exception to the Zoning Ordinance
for a front yard setback of 4'6" to construct a covered porch.
Anita Clark seconded the motion, which carried with a unanimous
vote.
At this time Norman Slocum arrived to the meeting.
~5 GENERAL DISCUSSION:
Ted Duigon•
Ted Duigon stated he had no comments at this time. He will
wait until Steve Simonson presents his comments on Tri-County
Business Park, and HEB.
Joyice Briscoe•
Joyce Briscoe stated she had no other comments and also would
wait for Steve's comments.
Steve Simonson:
Steve Simonson stated there is going to be a warehouse in
Tri-County Business Park which will be 244,800 square feet.

There are going to be three different companies leasing the
warehouse space. This could be the first of several to go in
this area. To get an idea of the size of the building you
could put 3 Instel Steels into this building.
Ted Duigon asked about the comment on several more gated
communities that Steve made in the notes to the BOA.
Steve Simonson stated at this time there are two gated
communities going through the public hearing process to be
rezoned. There is one between Dimrock and Woodland Oaks Drive
which is 10.2 acres. The other one will be 121 acres behind
HEB off of FM 3009 which will link Wiederstein Road and FM
3009. This will be a subdivision with some not gated which
will be the Estate lots located behind Deer Haven.
Joyce Briscoe asked if any of these developers were either
giving land to the City or money for park development?
Steve Simonson stated all of the developers either donate land
or pay per lot to the City. The percentage is half and half.
Ernie Evans•
Ernie Evans stated he had no comments.
Anita Clark:
Anita Clark stated next year's 4th of July carnival is now
being planned. This year's went very well. There is a
gentleman that is interested for next year but would like to
make it bigger. At this time the City does not have the space
to make the 4th of July any larger.
Norman Slocum•
Norman Slocum apologized for being late. His watch indicated
he was three minutes early.
Norman Slocum stated he has never participated in City
Government before he was elected to be on the BOA. Norman
stated he would like to credit Steve Simonson for showing him
all the maps and what was in the plans for long term. Santa
Clara Road was mentioned that some day could become a
thoroughfare to connect IH 10 to IH 35. Because of this Norman
developed an interest in the bigger Schertz. With the work
that Norman does, he is aware of what commercially is going to
occur in our area in less than ten years. IH 10 and IH 35 are
going to become big major international transportation
corridors. If you don't believe this, count the number of
truck related businesses from IH 10 to FM 1518 and IH 10 to
Loop 410. Norman hopes that someone will in a serious long
range planning for the City of Schertz at least look at three
commercial connecting corridors such as to the east Santa

Clara, something like FM 3009 in the central area and to the
west of the City may be FM 1518 but three connecting corridors
between IH 10 and IH 35. This will balance the controlled
commercial growth with the controlled residential growth by
developing connecting commercial corridors.
Chairman Earl Hartzoct:
Chairman Earl Hartzog asked if the Planning and Zoning
Commission could look at pool requests as an access building
allowing the setbacks within 10' of the house instead of having
to come to the BOA for an exception.
Steve Simonson stated this is a safety item so a storage shed
is not so close to the house storing gas, paints etc.

Chairman Hartzog adjourned the meeting at 6:30 p.m.
