06-24-1996BOARD OF' ADJUSTMENT MEETING June 24, 1996 The Schertz Board of Adjustment convened in regular session on Monday, June 24, 1996 at 6:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: BOARD OF ADJUSTMENT EARL HARTZOG, CHAIRMAN ANITA CLARK JOYCE BRISCOE JIM HARRIS, ALTERNATE ERNIE EVANS, P&Z COMMISSIONER OTHERS PRESENT Marvin Holland, 3205 Dusty Crossing MEMBERS ABSENT CITY STAFF TED DUIGON, VICE-CHAIRMAN (VACATION) STEVE SIMONSON, NORMAN SLOCUM ASST. CITY MANAGER DENISE GRANGER, PLANNING SECRETARY #1 CALL TO ORDER Chairman Hartzog called the meeting to order at 6:05 p.m. Chairman Hartzog advised the board that Merwin Willman has resigned as the ex-officio from the Planning and Zoning Commission. Ernie Evans will be taking his place as the ex-officio from the Planning and Zoning Commission. Also Jim Harris, an alternate, is present tonight as Ted Duigon is on vacation and he welcomed Mr. Harris. #2 APPROVAL OF MINUTES: Regular Session April 8, 1996. Chairman Hartzog asked if there were any questions or corrections on the minutes. Joyce Briscoe moved to approve the minutes for the regular session April 8, 1996. Anita Clark seconded the motion which carried as follows: AYES: Earl Hartzog, Joyce Briscoe, Anita Clark. ABSTENTION: Jim Harris. (Not present at said meeting) #3 PUBLIC HEARING: The Board of Adjustment to receive citizen input on a request from Marvin Holland, 3205 Dusty Crossing for a Special Exception to the Zoning Ordinance for a rear yard setback from 20' to 16' in order to put a patio cover over an existing slab. (BOA #73-96) Marvin Holland was at the meeting to represent this request. Chairman Hartzog stated the purpose of the Public Hearing is to receive comments from interested citizens. The Board of Adjustment will take all of the comments into consideration on their decision. After the Public Hearing is closed there will be no other comments taken. Chairman Hartzog asked for staff input. Steve Simonson stated in accordance with the ordinance for the Board of Adjustment, all property owners within a 300 foot radius were notified. There were 35 letters sent concerning this request, 10 were received back: all were in favor of this request for variance. This will not involve any utility easements or side yard easements. Chairman Earl Hartzog asked if any of the comments received back were from the person directly behind Mr. Holland on Freeport Drive? Steve Simonson stated there are only 3 lots behind Mr. Holland and the 2 letters received from the residents on Freeport were in favor. Chairman Earl Hartzog asked Mr. Holland if he had any comments for the BOA. Mr. Holland stated he had no comments, this is a very straight forward request. All of the neighbors that he has talked with have no problem with the request. Chairman Hartzog closed the Public Hearing at 6:08 p.m. with no other comments or questions. #4 CONSIDER AND TAKE APPROPRIATE ACTION: Consider and take action on the Special Exception request from Marvin Holland. (BOA #73-96) Anita Clark moved to approve the request from Marvin Holland, 3205 Dusty Crossing, for a Special Exception to the Zoning Ordinance for a rear yard setback from 20' to 16' in order to put a patio cover over an existing slab. Joyce Briscoe seconded the motion, which carried with a unanimous vote. #5 CONSIDER AND DISCUSS: following BOA Members: The reappointment of the 1. Norman Slocum 2. Anita Clark 3. Joyce Briscoe Chairman Hartzog advised that the above board members' terms will be up in August 1996 with this being a discussion at this -2- time to see how the members feel about being reappointed. At the next meeting the board will vote officially. Joyce Briscoe and Anita Clark both agreed to continue on with the BOA. Joyce stated she would like to continue with her contributions and civic duty. Chairman Hartzog stated with Norman Slocum being absent we don't know what his decision is. With Jim Harris being an alternate, appointed back in October, waiting to be called upon, if Norman Slocum is not interested in being reappointed then Mr. Harris could take Norman's place. Mr. Harris stated that would be fine with him. #6 GENERAL DISCUSSION: Chairman Earl Hartzog: Chairman Hartzog stated that Denise had informed him that Chairman and Vice-Chairman were appointed last year fora two year term. If the other board members would like, Earl stated he would relinquish being Chair if another board member is interested. The board members that were present stated Earl and Ted are doing an excellent job so at this time the positions will stay the same. Chairman Hartzog at this time asked Ernie Evans as the ex-officio from the Planning and Zoning Commission are there any words of wisdom for the BOA? He also stated that the P & Z is doing a good job. Ernie Evans• Ernie Evans stated he has no words of wisdom. Ernie advised he will enjoy being with the BOA. It is a good continuation of work that is done with the P & Z. There are issues that affect the residents of the City Ernie which like his predecessor will let the Board know. Steve Simonson: Steve Simonson stated unless there are any questions on the notes included in the packets there is no new information. Antia Clark commented that the tour was very good. Steve Simonson stated the tour was nice and wished everyone could have gone on the tour. The City is at a point where it needs to make some major decisions on the future for the next 20 years. With what was done earlier on IH 35 in the late 60's and 70's making sure that we have control of it. The real question is were do we go from here as a City. This is what the tour was about, looking at options the City has as far as annexation, and planning for the future. The City Council is looking for feedback from various groups that went on the tour. -3- Joyce Briscoe commented that as a City there are some very valued concerns which as a City we need to plan for. The expansion is needed, but we need to also look at some park development. With all the citizens coming in there is a need for this. This is worth some study and also input from the citizens on what they would like to see happen in the City. Anita Clark mentioned a sports complex. Also does the City have any land? Steve Simonson stated this is what the City Council is looking for: the feelings of the various groups in the City and also the citizens input on what they would like to see for the future. The City of Schertz does not have any land. There is good planning and bad planning. There were some mistakes made in the past not apparent at the time, but in today's perspective there were some mistakes. In the past there was some land offered to the City for free for parks and expansion etc. that was turned down. Other offers of land were also .turned down, today the City is very land poor. If the City wanted to build say a sports complex they would have to find d--.land-~- to develop, there would have to be water and good access to roads. Once the input is sent back to the City Council from the various groups there will be public meetings for citizens for their input also on what the City should do for the future. Ernie Evans stated in terms of development the City wants to expand park land, to keep green belts alive, and to work on a total concept of the City. It has been a number of years since the City has annexed and it is time to look at the future for the planning of the City. The City Council needs to look at the growth 10 to 15 years from now so it can expand and grow. The City needs to not only look at a sports complex but also the greenbelts, and walkways that can be expanded to make the City look nice and accommodate for the residents. All of the issues that are raised need to be looked at by the City Council for the future growth of the City and the City not becoming land locked. If anyone has any suggestions to please pass it on as the planning for the future needs to be done now on how it should be expanded in terms of growth etc. and to be able to grow the way the citizens would like. Joyce Briscoe mentioned in driving through Houston off of IH 45 they have some beautiful greenbelts with walkways. It is so relaxing and we need to preserve some of our wonderful green areas. Joyce Briscoe asked where the City is in terms of water? Steve Simonson stated the City is in very good shape. Johnny Bierschwale in long term planning has advised City Council and they have purchased rights to a certain amount of surface water from= Canyon Lake, and Lake Dunlap. This could be done by various water lines from different cities. The rights of the existing water has already been purchased. -4- Anita Clark: Anita Clark reminded everyone of the 4th of July Jubilee. There are several bands and lots of floats. If anyone can help it will be greatly appreciated. Joyce Briscoe• Joyce Briscoe stated she had no other comments. Jim Harris• Jim Harris commented he is one of those Schertz citizens that lives in Bexar County, on FM 1518 which is a pretty good size greenbelt and he hopes it stays this way. On the annexation part of IH 10 to Trainer Hale Road, from FM 1518 to Cibolo if the City hasn't annexed this area yet, there is going to be someone that is going to annex this. Steve Simonson stated this belongs to San Antonio's ETJ. Jim Harris mentioned we need to take this away from them. Jim Harris stated he lives. This in the City which Chairman Hartzog evening, and also & Z. there is alot is a good area was annexed b. thanked Jim thanked Ernie of "no man's land" around where to annex. Part of his land is Eck in 1985. Harris for filling in this Evans for taking over for the P Chairman Earl Hartzo Chairman Earl Hartzog stated the next meeting will be Monday July 1, at 6:00. p.m. Chairman Hartzog asked Steve if someone could do something about FM 3009 with no sidewalks for the children in the area to be able to cross the street. Are Deer Haven, Savannah Square, and Woodland Oaks somehow going to be connected? Steve Simonson stated Savannah Square, Woodland Oaks and Ashley Place will all be connected. There will be no need for the children to go out to either Schertz Parkway or FM 3009. With the topography out in this area with the dips, there is no way to get sidewalks. This is one of the reasons all the subdivisions mentioned would be linked together. The next big change on FM 3009 will be a stop light on Woodland Oaks Drive as there are too may subdivisions in the area.
