02-12-1996BOARD OF ADJUSTMENT MEETING February 12, 1996 The Schertz Board of Adjustment convened in regular session on Monday, February 12, 1996 at 6:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: BOARD OF ADJUSTMENT EARL HARTZOG, CHAIRMAN TED DUIGON, VICE-CHAIRMAN NORMAN SLOCUM ANITA CLARK JOYCE BRISCOE MERWIN WILLMAN, P&Z COMMISSIONER MEMBERS ABSENT OTHERS PRESENT Harry McMillin 3009 Bent Tree CITY STAFF STEVE SIMONSON, ASST. CITY MANAGER DENISE GRANGER, PLANNING SECRETARY #1 CALL TO ORDER Chairman Hartzog called the meeting to order at 6:00 p.m. #2 APPROVAL OF MINUTES: Regular Session January 8, 1996 Chairman Hartzog asked if there were any questions or corrections on the minutes. Ted Duigon moved to approve the minutes for the regular session January 8, 1996. Anita Clark seconded the motion which carried with a unanimous vote. #3 PUBLIC HEARING: The Board of Adjustment to receive citizen input on a request from Harry McMillin 3009 Bent Tree for a Special Exception to the Zoning Ordinance for a 4' variance into the 16' easement in the rear of the property to construct a swimming pool. (BOA #69) Harry McMillin was at the meeting to represent this request. Chairman Hartzog stated the purpose of the Public Hearing is to receive comments from interested citizens. The Board of Adjustment will take all of the comments into consideration on their decision. After the Public Hearing is closed there will be no other comments taken. Chairman Hartzog asked for staff input. Steve Simonson stated in accordance with the ordinance for the Board of Adjustment all property owners within a 300 foot radius were notified. There were 23 letters sent concerning this request, 10 were received back: all were in favor. The letters from Southwestern Bell and Paragon were distributed before the meeting. The recommendation from the Planning and Zoning Commission was included in the BOA packets. Mr. McMillin stated Southwestern Bell and Paragon came out to his residence to mark the areas where the cables are. Southwestern Bell now charges $150.00 for this service. The sidewalk will encroach about 3 to 4' into the easement. The pool will only be about 1' into the easement. Mr. McMillin thanked Steve Simonson for all of his help in the process. Chairman Hartzog asked if GVEC has any cables that would be affected, and is this property in the 100 year floodplain? Steve Simonson advised that all the electrical is in the front of the property in that area. As for the 100 year floodplain this would not be a problem. Chairman Hartzog closed the Public Hearing at 6:05 p.m. with no other comments or questions. ~4 CONSIDER AND TAKE APPROPRIATE ACTION: Consider and take action on the Special Exception request from Harry McMillin. (BOA #69) Norman Slocum moved to approve the request from Harry McMillin 3009 Bent Tree, for a Special Exception to the Zoning Ordinance to install a swimming pool. Joyce Briscoe seconded the motion, which carried with a unanimous vote. ~5 GENERAL DISCUSSION: Merwin Willman: Merwin Willman stated he had no comments. Anita Clark• Anita Clark asked about the property between the School Administrative Office and Sycamore Apartments where they are clearing the land. Steve Simonson advised that is the schools property to do what they would like. He is not sure what they are doing. Norman Slocum: Norman Slocum stated he had no comments. Jovice Briscoe• Joyce Briscoe stated she had no comments. -2- Ted Duiaon: Ted Duigon asked why the BOA meetings are not put on the marque board in front of City Hall? Steve Simonson said this is not a requirement. Notices are sent out to the property owners who are affected by the request. Steve Simonson advised he would check to see if the BOA meetings could be put on. Steve Simonson: Steve Simonson commented there is another industrial business, ITM, which should be breaking ground soon with three more lots being sold in the area. Seguin State Bank should be developing soon. Ted Duigon asked what type of business is Alamo Holly? Steve Simonson stated this business repairs meat making machines. HEB is their biggest customer. Steve Simonson mentioned now that Stop-N-Go has been taken over by Diamond Shamrock it is now much cleaner. As far as HEB there is no word at this time. Continental Homes is requesting to develop a gated community behind Deer Haven and Savannah Square. This will keep in going with the Master Plan for the City by having FM 3009 go through to Schertz Parkway by way of Savannah Drive.
