01-08-1996BOARD OF ADJUSTMENT MEETING January 8, 1996 The Schertz Board of Adjustment convened in regular session on Monday, January 8, 1996 at 6:00 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: BOARD OF ADJUSTMENT EARL HARTZOG, CHAIRMAN TED DUIGON, VICE-CHAIRMAN NORMAN SLOCUM ANITA CLARK JOYCE BRISCOE MERWIN WILLMAN, P&Z COMMISSIONER MEMBERS ABSENT OTHERS PRESENT Ernie Freeland 1504 Red Cedar Cove CITY STAFF STEVE SIMONSON, ASST. CITY MANAGER DENISE GRANGER, PLANNING SECRETARY #1 CALL TO ORDER Chairman Hartzog called the meeting to order at 6:00 p.m. Chairman Hartzog welcomed everyone back for the new year. #2 APPROVAL OF MINUTES: Regular Session October 2, 1995 Ted Duigon advised on the first page under Steve Simonson's name the word Manger needs to be changed to Manager. Joyce Briscoe moved to approve the minutes for the regular session October 2, 1995 as corrected. Norman Slocum seconded the motion which carried with a unanimous vote. #3 PUBLIC HEARING: The Board of Adjustment to receive citizen input on a request from Ron Wood, 1504 Red Cedar Cove for a Special Exception to the Zoning Ordinance to construct a U-Shaped Driveway. (BOA #68) Ernie Freeland prospective owner of property was at the meeting to represent this request. Chairman Hartzog advised the purpose of the Public Hearing is to receive comments from interested citizens. The Board of Adjustment will take all of the comments into consideration on their decision. After the Public Hearing is closed there will be no other comments taken. Ernie Freeland asked if everyone on the BOA was aware why he was asking for the circular driveway? Ted Duigon advised he was out in the area. Is the driveway going up to the garage and around the tree? Ted advised his other concern is all the green boxes that Paragon Cable is putting in the front yards. Ernie Freeland advised that the driveway would go up to the two car garage then north between the large tree and the house. There will be heavy landscaping with not much grass. Ernie Freeland mentioned that the reason for the circular driveway was due to the fact that his wife has a car, his father-in-law has a car, his son and also himself. With not being able to afford to put in a four (4) car garage, this was the next practical stand point. Ted Duigon asked if the City would be responsible for the cutting of the driveway? Chairman Hartzog advised that is the responsibility of the builder and homeowner. Joyce Briscoe commented that she also had been in the area and the circular driveways are very nice if they are maintained properly but could be a problem if junk cars are being parked in them. Chairman Hartzog asked Merwin Willman if this request went before the Planning and Zoning Commission, if so did they have any comments? Merwin Willman advised that yes this did go before the Planning and Zoning Commission the only concern they had were the ones mentioned. Norman Slocum mentioned for clarification there are two issues: one requesting the circular driveway with two (2) curb cuts and the request from the Planning and Zoning Commission for any ideas or guidelines on how the BOA wishes to handle this type of request. Earl Hartzog advised that the requests would be handled individually. With no other comments or questions Chairman Hartzog closed the Public Hearing at 6:08 p.m. #4 CONSIDER AND TARE APPROPRIATE ACTION: Consider and take action on the Special Exception request from Ron Wood. (BOA #68) Ted Duigon moved to approve the request from Ron Wood, 1504 Red Cedar Cove, for a Special Exception to the Zoning Ordinance to construct a U-Shaped Driveway. Norman Slocum seconded the motion, which carried with a unanimous vote. #5 GENERAL DISCUSSION: -2- Chairman Earl Hartzo Chairman Hartzog stated at this time there is a request from the Planning and Zoning Commission on any guidelines or comments that the BOA has on how to handle this type of request. Ted Duigon commented that the circular driveways could become a parking lot with all the vehicles. What does it matter if the curbs are cut? Chairman Hartzog advised in some subdivisions in certain areas you would not want more than one curb cut because of the traffic flow. Steve Simonson stated with slot of the subdivisions the way the houses are laid out, no two (2) driveways would back up together. The other problem in most of the other subdivisions is there is not sufficient width to be able to turn. In the ordinance there is a caveat that states the City Manager can authorize the extra curb cuts. However that is not the question. The question is with the continuing growth with upper scale homes, it is becoming more and more of a question for extra curb cuts. Steve mentioned he asked the Planning and Zoning Commission for some guidelines to be able to follow. Steve Simonson mentioned that the curb cuts would not be allowed on a major thoroughfare. Traffic pattern will be a major concern, also the width of the lot. The Planning and Zoning Commission has asked that the BOA discuss and see if they have any guidelines that they would like to be able to follow for this type of circular driveway. Norman Slocum asked if there are any guidelines on how wide a circular driveway can be? Steve Simonson advised that he could get that information from the Engineer. After the discussion the BOA was in agreement that the requests for circular driveways should be handled individually and come before the BOA for approval or disapproval. Merwin Willman• Merwin Willman stated he had no comments. Anita Clark• Anita Clark stated she had no comments. Jovice Briscoe• Joyce Briscoe stated she had no comments. Norman Slocum• -3- Norman Slocum stated he had no comments. Ted Duigon• Ted Duigon stated he had no comments. Steve Simonson: Steve Simonson mentioned he heard that HEB will be breaking ground by the end of 1996. There are at least four (4) possibly six (6) new industrial sites along FM 3009 in Tri-County and in Vestal Subdivision. Texaco, Seguin State Bank with beautiful landscaping. The industrial in Tri-County behind the Keebler building should begin construction within 60 days. It is a precision tool manufacturing company out of San Antonio. There will be a two (2) story office building going up in front of Mobile Villa which will be Remax. Ashley Place is selling so fast they are platting for Ashley Place Unit 3. There is a site plan for a school behind Savannah Square. Joyce Briscoe asked how plans are coming along with FM 78? Steve Simonson advised until there is a ROW map there can be no planning. There are businesses along FM 78 that are willing to help out in the planning but until the City receives the ROW map it is all on hold. Bexar County has said they will not participate, so the road under the underpass will not be included at this time. Norman Slocum asked about the long range for annexation? Steve Simonson stated that the Planning and Zoning Commission has been working on a plan for the last three (3) months.
