08-16-1999~i BOARD OF ADJUSTMENT MEETING August 16, 1999 The Schertz Board of Adjustment convened in regular session on Monday, August 16, 1999, at 6:30 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: BOARD OF ADJUSTMENT Earl Hartzog, Chairman Ted Duigon, Vice-Chairman Anita Clark Kathy Hill Joyce Briscoe, ex-officio CITY STAFF Steve Simonson, Asst. City Manager Mary Ybarra, Planning & Recording Secretary MEMBERS ABSENT Peggy Brown, (work related) #1 CALL TO ORDER OTHERS PRESENT Karen Mayo, 3733 Davenport Chairman Hartzog called the meeting to order at 6:30 p.m., and welcomed Kathy Hill, Board of Adjustment alternate to the meeting. She will be sitting in, due to Jim Harris being out of town. #2 APPROVAL OF MINUTES: Regular session of July 12, 1999. Earl Hartzog asked for any corrections or additions to the minutes of July 12, 1999. With no corrections or additions, Ted Duigon moved to approve the minutes of July 12, 1999, as written. Anita Clark seconded the motion that carried unanimously. #3 PUBLIC HEARING: The Board of Adjustment is to receive citizens input on a request from Raymond & Karen Mayo for a Special Exception to the Zoning Ordinance to encroach 9' into the 12' rear yard utility easement to place an above ground pool. (BOA #125-99). 1 Chairman Hartzog stated that the purpose of the public hearing is to receive comments from interested citizens. The Board of Adjustment will take all of the comments into consideration in its decision. After the public hearing is closed there will be no other comments taken. Earl Hartzog asked for staff input. Steve Simonson stated that in accordance with the City ordinance 27 letters were sent out to property owners within 200' radius of said property. Of the letters sent three letters was received in favor and none were received opposed. Earl Hartzog asked that if the Board took action and approved the request, the citizen does understand that if the pool needs to be moved, it would. Chairman Hartzog was advised that Mr. & Mrs. Mayo are aware and it's their responsibility if a move is necessary. It has also been advised that the weight .(pool) will not affect the utility easement. Steve Simonson stated that this request is a first, in regard that the pool would cover the whole area of the utility easement. Joyce Briscoe reported that Planning & Zoning did not see a problem with recommending approval on the request, as long it was understood that if the pool needed to be moved it would. Karen Mayo stated she has been made aware that if the pool needed to be moved for maintenance purpose there isn't a problem. With no further comments voiced, Chairman Hartzog closed the public hearing. #4 CONSIDER AND TAKE APPROPRIATE ACTION: On the above Special Exception request from Raymond & Karen Mayo, 3733 Davenport. (BOA #125-99) Chairman Hartzog asked if there were any questions or concerns. Ted Duigon commented that he was in favor of the request The school is the only neighbor behind the home which is 40 yards from the school. With no further discussion, a motion was made by Ted Duigon and seconded by Kathy Hill to approve the request from Raymond & Karen Mayo for Special Exception to the Zoning Ordinance to encroach 9' into the 12' rear yard utility easement to place an above ground pool. With a vote being called, the motion was approved. 2 #5 GENERAL DISCUSSION: Kathy Hill: Kathy had no comments, only to say that she was happy to see everyone. Ted Duigon: Ted had no comments. Anita Clark: Anita advised everyone that she would be moving and a replacement would be needed. Her family would be moving to the outskirts of Marion. The move would take place around the 30~' of September. Joyce Briscoe: Joyce mentioned that for the next three months she would be very busy with her Church committee and would not be attending many of the meetings. Steve Simonson: Steve reported that Tri-County is building up fast. A new warehouse facility (163, 000 square feet) will be ready to build soon. Steve was asked if the City has adequate fire protection to cover the area. Steve advised the Board that the City does have adequate fire protection. At the present time there isn't protection for two-story structures. However, the development in the Tri-County area is all single structure buildings. Steve reported that construction for the FM 78 project would commence at the end of August or the first of September. The City has purchased all parcels. Steve mentioned that he is anxious to see construction of the bridge at Cibolo creek. Steve mentioned that 19 acres has been purchased along IH35 next to the Schertz Bank and there are plans for a car dealership and restaurant. At this time, he is not obligated to tell the Board what dealership. 3 Earl Hartzog: Earl mentioned a point of interest if anyone was interested.
