December 4, 2000
The Schertz Board of Adjustment convened in regular session on Monday,
December 4, 2000 at 6:30 p.m. in the Municipal Complex Council Chambers,
1400 Schertz Parkway, Schertz, Texas. Those present were as follows:

Chairman Hartzog called the meeting to order at 6:30 p.m.
#2 APPROVAL OF MINUTES:
Kathy Hill moved to approve the Minutes of September 11, 2000 as corrected.
Ted Duigon seconded the motion which carried with the following vote:
Ayes: James Harden, Earl Hartzog, Ted Duigon and Kathy Hill.
Abstentions: Jim Harris
Kathy Hill moved to approve the Minutes of October 2, 2000 as corrected. Jim
Harris seconded the motion and the motion was unanimously approved.
#3 Public Hearing: Request from Highland Homes, Woodbridge
Subdivision, 498 Covered Bridge, Lot 63, Blk. 24 for a special exception to the
zoning ordinance to allow an encroachment of 6' into the 50' building setback line
for construction of a home. (BOA#150-00)
At this time, Chairman Hartzog asked for staff input.
Leonard Truitt stated this is a request from Highland Homes fora 6' exception to
the rear setback (50') off Schertz Parkway. They are dealing with a 10' drainage
easement on the side and a utility box that make it a little difficult for placement of
this particular house on this lot.
Joyce Briscoe stated that the Planning and Zoning Commission recommended
approval. There was some discussion again regarding granting the variance.
Chairman Hartzog inquired if there was anyone wishing to speak on this item.
Paul Starkey commented that he lives at 487 Covered Bridge and he did not
receive a letter concerning this variance request.
Leonard Truitt, upon checking the list, stated Mr. Starkey's name was not on the
list.
Paul Starkey inquired of any long-term plans for Schertz parkway to be
expanded to a four-lane versus the (current) two-lane. Chairman Hartzog replied
that it is eventually to be four-lane with a center turn lane when the money is
available. There is a 50' building setback on Schertz Parkway and also on
FM3009. Mr. Starkey's only other concern was that he had learned of the public
hearing from a neighbor and had not been notified by letter of the meeting.
With no additional comment or discussion, Chairman Hartzog closed the public
hearing.
#4 CONSIDER AND TAKE APPROPRIATE ACTION: Request on the
above special exception to the Zoning Ordinance for Highland Homes, 498
Covered Bridge.
At this time, Earl Hartzog asked for questions or comments.
Ted Duigon commented that he had taken a look at the situation and he doesn't
see a problem due to the fact that there would never be development behind the
home.
James Harris commented that he believes that the builders are well aware of the
lot size and should build accordingly to fit the lot
With no further discussion, Kathy Hill moved to approve the request from
Highland Homes, Woodbridge Subdivision, 498 Covered Bridge, Lot 63, Blk. 24
for a special exception to the zoning ordinance to allow an encroachment of 6'
into the 50' building setback line for construction of a home. Ted Duigon
seconded the motion. With a vote being called, the motion was unanimous.
Motion approved.
#5 General Discussion:
Chuck Sharpe member of the Board of the Schertz Parkway Improvement was
present and was asked to report on the status of the Schertz Parkway Zone
project. Mr. Sharpe stated that the money is a factor due to the school district
and county having withdrawn from the project, which leaves the City of Schertz
responsible for funding the project. At this time the project is waiting on a grant
from FEMA for drainage work along Live Oak Road and Schertz Parkway. In the
very near future the contract will be let out for bids.
James Harden:
James asked if the bandit sign issue has been resolved? Leonard Truitt reported
that the issue has been resolved. TROT will not allow any signage on FM3009.
James mentioned that the Stage Coach House would be moved sometime this
month. James also mentioned plans to move the nursery office to the Schertz
location.
Ted Duieon:
Ted commented that there are too many large houses going onto small lots, with
exception to the zoning ordinance.
Kathv Hill:
Kathy mentioned that for the record she can be reached at work number 565-
2435.
Leonard Truitt:
Leonard reported that Block Distributing is up and running in the Tri-County
Business & Industrial Park.
Leonard also reminded everyone that Dec. 15~' at 6:30 p.m. has been scheduled
to meet the candidates for City Manager. There are four candidates up for
consideration. Of the candidates two are from out of state, one locally and two
from the surrounding area.
Leonard also reported that there is good news on Johnny Woodward's prognosis.
There has been some response to treatment.
Earl Hartzos~:
Earl commented on the Bridge on FM78. When will vehicles be allowed to drive
across the bridge? Leonard replied that he heard that sometime in November the
bridge would be passable.
Earl mentioned that a BOA meeting was scheduled for December 18, 2000.
