January 8, 2001
The Schertz Board of Adjustment convened in regular session on Monday,
January 8, 2001 at 6:30 p.m. in the Municipal Complex Council Chambers, 1400
Schertz Parkway, Schertz, Texas. Those present were as follows:

#1 CALL TO ORDER

Danny Tackett, Highland Homes
Chairman Hartzog called the meeting to order at 6:30 p.m., welcomed everyone
back and wished everyone a Happy New Year.
#2 APPROVAL OF MINUTES:
Chairman Hartzog stated that the minutes of December 4, 2000 were not
published.
#3 Public Hearing: Request from Highland Homes, Woodbridge
Subdivision, 498 Cedar Bridge, Lot 50, Blk. 24 for a special exception to the
zoning ordinance to allow an encroachment of 6' into the 50' building setback line
for construction of a home. (BOA#151-00)
Without further delay, Chairman Hartzog reminded everyone present that the
purpose of a public hearing is to receive comments from all interested citizens.
The Board of Adjustment will take all comments into consideration in making their
decision. After the public hearing is closed, there will be no other comments
taken from the citizens on this matter.
At this time, Chairman Hartzog asked for staff input.
Leonard Truitt stated this is a request from Highland Homes fora 6' exception to
the rear setback (50') off Schertz Parkway. Leonard mentioned that the request
is the same as the last request from Highland Homes at the December 4,
meeting. They are dealing with a 4' to 6' encroachment at the right corner of the
home. Fourteen letters were sent out and received only one back in favor. None
were received opposed.
Joyce Briscoe stated that the Planning
approval. There was some discussion
happens to be the fourth request so far.

again regarding granting variances, this
Chairman Hartzog inquired what were the lot sizes? Leonard Truitt replied that
the lot sizes are R-1's. These lots are very large, however the problem seems to
be the 50' set back from Schertz Parkway.
Chairman Hartzog inquired if there was anyone wishing to speak on this item.
With no additional comments or discussion, Chairman Hartzog closed the public
hearing.
#4 CONSIDER AND TAKE APPROPRIATE ACTION: Request on the
above special exception to the Zoning Ordinance for Highland Homes, 498
Cedar Bridge.
At this time, Earl Hartzog inquired if there were any questions or comments.
James Harden commented that if BOA keeps approving these variances there
would be no stopping to the requests.
Chairman Hartzog asked how large was the home and was advised by Danny
Tackett that the home was over 4,000 sq. ft. Earl Hartzog commented that these
type of issues need to be addressed at the Planning and Zoning Commission. He
believes these issues should be covered at the platting stage.
Leonard Truitt commented that pie shape or irregular lots would always have
difficulty because of their shape, however in this case the home proposed is
larger then most.
Danny Tackett commented that cul-de-sac lots that back onto Schertz Parkway
can't accommodate single story homes, that's why the decision was made to go

with a two story, even then the home will encroach 4-6 feet at that one corner.
James Harris stated that it's his understanding that this would be a recurring
issue as long as larger type homes are placed in cul-de-sac lots. Mr. Tackett
advised the Board that there are two more cul-de-sacs throughout the
subdivision and in all probability would need variances.
James Harris inquired if anything can be done in the Planning and Zoning
process to stop these variance requests. Joyce Briscoe stated that she would
share the Board's concerns with the Planning and Zoning Commission.
With no further discussion, James Harris moved to approve the request from
Highland Homes, Woodbridge Subdivision, 498 Cedar Bridge, Lot 50, Blk. 24 for
a special exception to the zoning ordinance to allow an encroachment of 6' into
the 50' building setback line for construction of a home. James Harden seconded
the motion. With a vote being called, the motion was approved.
At this time, Danny Tackett suggested sending a letter to the Company stating
that the Planning and Zoning Commission was not going to approve anymore
variances for irregular size lots. The homebuyer would be advised that only
certain size house would be allowable.
#5 General Discussion:
James Harden:
James reported that plat for moving corporate offices to the Schertz Nursery
location was going to be considered at the Planning and Zoning meeting
tomorrow evening.

Joyce reported that Planning and Zoning would be looking at the city's zoning
map, for the purpose of some possible zoning changes.
Earl Hartzog mentioned having read that the city is looking fora "Planner". Joyce
stated that the Commission had been informed at the last meeting of the city's

plan to hire a "Planner". However, she doesn't know the particulars. She did see
the advertisement on the Internet.
Joyce reported that the Commission has also had a request for a zoning change
for property along FM3009 starting at Greenfield Vllage to Elbel Road and FM78
railroad ROW. The request proposes to change General Business (GB) to
Neighborhood Services (NS) and R-1 to Multi-family.
Leonard Truitt:
Leonard reported that there are two issues that are going before the Commission
at their next meeting. The Wynn Brook Subdivision School Site on Green Valley
Road and a Specific Use Permit allowing a school site along Schertz Parkway
and Savannah Drive.
James Harris inquired on the status on the selection of a new City Manager and
was advised by Mr. Truitt that selection was made. Dewy Cashwell from Virginia
was offered the position. At this time, negotiations are taking place. If Mr.
Cashwell accepts there is a possibility of arrival around February.
