The Schertz Board of Adjustment convened in regular session on Monday, March 5,
2001, at 6:30 p.m. in the Municipal Complex Council Chambers, 1400 Schertz Parkway,
Schertz, Texas. Those present were as follows:

Chairman Hartzog called the meeting to order at 6:30 p.m.
#2 APPROVAL OF MINUTES: Regular session of February 12, 2001.
Chairman Hartzog asked if there were any corrections or additions to the minutes of
February 12, 2001?
Kathy Hill pointed out that on page two, fourth sentence of paragraph nine, change the
word "forward" to read "forwarded".
With no further corrections or additions, James Harris moved to approve the minutes of
February 12, 2001 as corrected. Kathy Hill seconded the motion. With a vote being
called, the vote was as follows:
Ayes: James Harris, Earl Hartzog, Ted Duigon and Kathy Hill.
Motion approved.
#3 PUBLIC HEARING: To receive citizen input on a request from John L.
Hollingsworth, 2615 Cove Trail for a special exception to the zoning ordinance to
encroach into the 20' rear yard setback from 20' to 12' for construction of a wooden deck.
Chairman Hartzog stated that the purpose of the public hearing is to receive comments
from interested citizens. The Board of Adjustment will take all comments into
consideration in its decision. After the public hearing is closed there will be no other
comments taken.
Chairman Hartzog asked for staff input.
Leonard Truitt stated that in accordance with the city ordinance 231etters were sent out to
property owner's within a 200' radius of said property. Of the letters sent (2) two letters
was received in favor and (2) two letters were received opposed, which are part of the
Board's packet, however two more letters were turned in this evening making it a total of
(4) four letters opposed. The addresses of these letters are 2608 & 2612 Tree Crown.
Earl Hartzog made note that also part of the packet is a letter from the Homeowners
Association giving their approval. Chairman Hartzog also mentioned that he had driven
by the location and stated that the yard is very attractive, patio is very nicely landscaped
and believes deck would improve the yard.
At this time, Chairman Hartzog asked if anyone wanted to speak on the matter before the
Board, with none voiced Chairman Hartzog closed the public hearing.
#4 CONSIDER AND TAKE APPROPRIATE ACTION: On the above Special
Exception request from John L. Hollingsworth, 2615 Cove Trail.
James Harris inquired if the deck would be covering the patio and was advised by Mr.
Hollingsworth that the deck would be build on top of the existing patio and that the patio
is approximately 21' from the back of the house.
Ted Duigon asked if a patio slab was concerned flat work and was advised yes by
Leonard Truitt building official.
There was brief discussion among the Board in regard to privacy to back yards happening
to be at lower levels. It was mentioned that the deck would be level with the back door
and privacy would not be an issue.
With no additional comments, Ted Duigon moved to approve the request from John L.
Hollingsworth, 2615 Cove Trail for a special exception to the zoning .ordinance to
encroach into the 20' rear yard setback from 20' to 12' for construction of a wooden deck.
James Harris seconded the motion. With vote being called, the vote was unanimous.
Motion approved.
#5 GENERAL DISCUSSION:
James Harris:
James had no comments.
Ted Dui~on•
Ted inquired if there could possibly be a time limit on letters returned from property
owners. He would like to see all letters as part of the Board's packet and not have letters
turned in at the time of the meeting.
Kathy Hill:
Kathy had no comments.
William Sommers•
William commented that after reading minutes of the previous meeting and being elected
Planning and Zoning representative to sit at BOA meetings he would like to inquire on
the curb jumping issue that was discussed at the last meeting. The Board advised William
that there is no city code prohibiting jumping curbs and the Board would like the
Planning and Zoning Commission to look into possibly coming up with something to
prohibit this concern.
Leonard Truitt•
Leonard reported that Ron Youngblood City Planner could not sit in on the BOA meeting
this evening because of the Comprehensive Plan for the City of Schertz meeting was
scheduled at the same time. He sends his apologize and plans to attend the next BOA
meeting.
Leonard reported on a house clean up on Antler Street. The homeowner is taking care of
the demolition removing the home as a result of a house fire.
Leonard mentioned the Library open house scheduled for Monday March 12a' from 4:30
to 5:30.
With no further business the meeting was adjourned.

Chairman Hartzog adjourned the meeting at 7:00 p.m.
