08-08-1995 PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission conducted a public hearing on Tuesday, August 8, 1995 at 7:00 p.m. in the Municipal Complex Conference Room, 1400 Schertz Parkway, Schertz, Texas. The City Council public hearing on this item will be held August 15, 1995. ~2 PUBLIC HEARING: To Receive Citizen Input on a Request from M. W. Cude, Engineers, for the Rezoning of 1.0084 Acres at the corner of Dimrock and FM 3009 (Roy Richard Drive) from NS (Neighborhood Services) to R-6 Single Family Dwelling District) (ZC#122) Chairwoman Jarman asked for Staff input. Steve Simonson stated the rezoning request is a standard request. It is zoned NS (Neighborhood Services) which is in front of the entire Woodland Oaks Subdivision from property line to property line. There will be a 100' depth of the NS (Neighborhood Services) lot that will be left on this property fronting FM 3009. The property to be rezoned is surrounded by Dimrock which has an 80-86' ROW, a drainage channel on the west and south. There were five letters sent to property owner's within 300'. There were no letters returned. Ray Swan stated that his property borders the property that is going to be rezoned. Ray Swan asked for clarification that the property will have a 100' depth on FM 3009 that will stay zoned NS (Neighborhood Services) and that the property is surrounded by a drainage channel. Steve Simonson advised Mr. Swan that was correct. There being no other questions or discussion, the Public Hearing on the rezoning for Woodland Oaks Subdivision was closed. ~3 ADJOURNMENT OF PUBLIC HEARING: Chairwoman Pia Jarman adjourned the Public Hearing at 7:07 p.m. The Schertz Planning and Zoning Commission convened in a regular session, after the public hearing. ~4 CALL TO ORDER: Chairwoman Pia Jarman called the August 8, 1995 regular meeting to order at 7:08 p.m. #5 APPROVAL OF MINUTES: Regular Session for July 25, 1995. Mervin Willman moved to approve the July 25, 1995 Regular Session Minutes as written. Tony Moreno seconded the motion, which carried with a unanimous vote. #6 CITIZENS: INPUT OTHER THAN AGENDA ITEMS There were none. #7 CONSIDER AND MAKE RECOMMENDATION: Request from M.W. Cude Engineers, for the Rezoning of 1.0084 Acres at the corner of Dimrock and FM 3009 (Roy Richard Drive) from NS (Neighborhood Services) to R-6 (Single Family Dwelling District) (ZC #122) Pia Jarman asked if there were any questions from the Commissioners at this time. There were none. Mervin Willman moved to approve the request from M. W. Cude, Engineers, for the Rezoning of 1.0084 Acres at the corner of Dimrock and FM 3009 (Roy Richard Drive) from NS. (Neighborhood Services) to R-6 (Single Family Dwelling District). Ernie Evans seconded the motion which carried with a unanimous vote. -2- #8 CONSIDER AND MAKE RECOMMENDATION: Request from Harley & Alma Rothrock, 812 Mitchell for a Special Exception request for a side yard setback to extend their carport to the property line. (BOA #65) Steve Simonson stated this is a very straight forward request to extend their carport to the property line with a side yard setback. The property owners are aware that the roof line being the property line there will be gutters so no water runs into the neighbor's property. Tony Moreno moved to recommend to the BOA approval for the request for a Special Exception from Harley & Alma Rothrock, 812 Mitchell, for a variance to the side yard setback to extend their carport to the property line. Merwin Willman seconded the motion which carried with a unanimous vote. #9 CONSIDER AND MAKE RECOMMENDATION: Request from Herbert Rehmann,Schertz, Cibolo, Universal City, ISD to construct a new Intermediate School (Grades 5-6) (SPU #95-5) Steve Simonson mentioned there is no PUD zone classification, so in going through the Single Family Dwelling District a Specific Use Permit would permit this type of a change. There is a lot of cooperation between the school, the Engineers for Ashley Place and RAYCO to get the school put in. This will meld together, Ashley Place, (Inglewood which will front the school property on the west, Savannah Drive on the north) the rear of the property, to the existing homes on Davenport and the existing Savannah Square Subdivision. This will be the first subdivision to go out on Schertz Parkway and try to alleviate traffic on FM 3009. All the utilities for the school are already available through Ashley Place or Savannah Square. This is a request from the school for a public hearing with the City Council. All fees have been paid. Merwin Willman asked if the property should be subdivided. Steve Simonson stated there is no need, it has already been platted. Ernie Evans asked which side of Schertz Parkway the school will be on. Steve Simonson advised it will be on the east side right on Savannah Drive. It backs up to Davenport and the existing homes and also Ashley Place Unit 3. Tony Moreno moved to recommend to City Council that a public hearing be scheduled for a Specific Use Permit for the Schertz, Cibolo, Universal City, ISD, to construct an Intermediate School (Grades 5-6). Keith Van Dine seconded the motion which carried with a unanimous vote. #10 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Dave Allen, MBC Engineers for Final Plat Approval for Seguin State Bank (PC #226-95) -3- Steve Simonson advised this is the final plat approval for Seguin Bank. Part of the delay has been the concern for the sewer but it has been resolved with construction beginning in, hopefully, 30 to 45 days. Pia Jarman asked about the flood statement having to be changed. Steve Simonson advised that the preliminary plat was approved before the letter of revision was submitted. There are no changes needing to be done on the final plat. Merwin Willman moved to approve the request from Dave Allen, MBC Engineers for the final plat for Seguin State Bank. Tony Moreno seconded the motion which carried with a unanimous vote. #11 CONSIDER AND TAKE APPROPRIATE ACTION: Request from Carl Bain, Engineers & Surveyors, for Final Plat Approval for Vestal Subdivision (PC #223-95) Steve Simonson advised that this is a revised final plat approval as the final plat had already been approved. At the request from the owner they wanted to add more lots. With this plat not being recorded, the owner was advised to submit a revised final plat for approval showing all of the changes. Carl Bain explained the two (2) new lots that they are hoping to add are on Red Iron; one on the south east side to the easement line is lot 3 which is 5.629 acres. Lot 4, which is 4.7 acres which is on the edge of the easement line to Pipe Stone. The only other change is lots 5 & 6 which were one lot is now being divided into two (2) lots. There will be three (3) changes to be made to the final revised plat. All of the utilities and roads will stay the same. Steve Simonson stated that the already approved and under construction street infrastructure drainage has not changed. Merwin Willman stated the variance given to the one (1) exit and entrance and cul-de-sac was not clear in the pertinent minutes. Steve Simonson advised the variance was given for one (1) exit/entrance. The cul-de-sac on Pipe Stone added an outlet and follow on. At the time Mr. Vestal was considering buying the property surrounding the area with the intent to come out onto FM 3009. They did put in what amounts to a 200' cul-de-sac with a commercial turn around. It is not so densely populated that the Fire Department, EMS, or Police could not respond. Tony Moreno moved to approve the request from Carl Bain, Engineers & Surveyors, for the revised final plat approval for Vestal Subdivision contingent upon correction of the sheet numbering. Keith Van Dine seconded the motion which carried with a unanimous vote. -4- X12 CONSIDER AND TARE APPROPRIATE ACTION: Request from Don McCrary, McCrary and Associates, for Final Plat Approval for Ashley Place, Unit 2 (PC #243-95) Steve Simonson stated the street names have been added to the final plat and all of the utilities easements have been brought to the front of the property line as requested by the Commission. The flood plain has been corrected. On sheet 2 of 2 you will see the stub out for Inglewood Drive for the school. Steve Simonson commended and thanked the Engineers and everyone involved making this stub out compatible with the school area. Pia Jarman questioned the check list page 3, letter T, in reference to park area to see the Master Plan. Steve Simonson advised a look at sheet 2, where Ashley Park and Baldwin Park meet is the area where the park will be located, which is part of the Master Plan. This green space is over 4 acres to be used for the park. Merwin Willman mentioned that the approval for the name of the park to be Baldwin Park was given August 2, 1994. Ernie Evans mentioned the notes from the inspectors. It states the parkland dedication or fee was not identified on the plat. Ernie Evans questioned the insert map not showing the easement of the 5' minimum between houses. Steve Simonson stated it is on the Master Plan for Unit 1 that there will be 18 acres that will be dedicated for park land in the next phase. Steve Simonson advised the 2.5 is showing the width of the property easement but there will be 5' on each side of the property line with a total of 10'. Merwin Willman moved to approve the final plat for Ashley Place Unit 2. Ernie Evans seconded the motion which carried with a unanimous vote. X13 CONSIDER AND TAKE APPROPRIATE ACTION: Request from M. W. Cude, Engineers, for Final Plat Approval for Woodland Oaks Unit 5-A (PC #240-95) Steve Simonson mentioned that the flood plain information has been corrected, the lots have been identified. Also as shown on sheet 3 of 3, the important thing is how the drainage will work through the area at the end of the cul-de-sac from Dimrock and Unit 5-A. The construction plans for the subdivision have been approved. Pia Jarman mentioned that on sheet one (1) of three (3) the street names have been put in the right place. Merwin Willman questioned the 10' utility easement on sheet 2 the lots backing up to Woodland Oaks Drive. Steve Simonson stated the utilities are showing in the front yard to be able to go to the next unit so they can carry it along -5- Woodland Oaks Drive. They have also added the 1' non access easement through Woodland Oaks Drive, Unit 4 and following along for Unit 5. It is showing the typical 5' electrical service easement adjacent to the property line to the house. The site plan location map is laid out and the area is also heavily treed. Mervin Willman questioned the plat for Unit 6: the park area on the map is showing an 8' drainage easement with a 4' concrete drain going through the park area. It is not shown on this plat. Steve Simonson explained that he and Mike Cude had discussed that situation and have decided to take out the channel and put in a gentle grassy swale. It will be similar to what is now at our existing park on Oak Street. The water will run gently out of the area. It will still be a play area. The park area is up to the City to develop. Tony Moreno moved to approve the request from M. W. Cude, Engineers, for final plat approval for Woodland Oaks Unit 5-A. Mervin Willman seconded the motion which carried with a unanimous vote. X14 CONSIDER AND MAKE RECOMMENDATION: Request from M. W. Cude Engineers, for Preliminary Plat Approval for Woodland Oaks Unit 6-A (PC #245-95) Steve Simonson mentioned the drainage easement that is shown will be taken out as indicated earlier. It will be shown as a swale but not a concrete drainage. The signature blocks are missing and will need to be added. The only question Steve Simonson has is in block 3 lots, how are they being numbered? Mike Cude advised that they follow along with Unit 3. Steve Simonson mentioned there was a problem at another time but for clarification he wanted to be sure that this was a follow on with Unit 3. If you were to take the part of land with no streets it would be one unit of land. This was an educational plat as all the water lines and construction items are being shown. If you were to drive off of FM 3009 all the way to the end of Woodland Oaks Drive that is were the stub out is. If you were to go north to Savannah Drive and get above the existing Woodland Oaks Drive all the property north and east, which is not platted at this time, will be Ashley Place. The ROW will be the stub out to Ashley Place so they can dedicate that property for the park land. This being the only other road besides Hillview that Woodland Oaks has going north. RAYCO is now looking at the Sagemont property to have a better front to go out to FM 3009. There are several items that need to be corrected but the plat was brought to the Commission to show how Unit 5 and Unit 6 would interact. The plat can either be approved with the corrections as stated or disapproved and a new plat submitted. Ernie Evans asked if the drainage road that excises behind the houses from Cotton King between block 3 houses, is a 10' open -6- drainage easement. Steve Simonson confirmed that is a 10' open drainage easement. Pia Jarman mentioned the items that are missing: the Engineers' statement, lot dimensions, street names, 1' non access easement on lot 1, block 22 and the park land dedication. Steve Simonson commented that the drainage through the park will be taken off with a different statement, also the water meters and water lines will not be shown. With the additions as stated needing to be added. Merwin Willman moved to disapprove the request from M. W. Cude, Engineers, for preliminary plat approval for Woodland Oaks Unit 6-A. Keith Van Dine seconded the motion which carried as follows: AYES: Pia Jarman, Merwin Willman, Ernie Evans, Keith Van Dine. NAYS: Tony Moreno. ABSTENTIONS: None. Steve Simonson asked if the Commission would accept a corrected preliminary plat and final plat on the same night. The Commissioners were in agreement if all the corrections were made on the preliminary plat they would except the preliminary plat and final on the same night. #15 CONSIDER AND MAKE RECOMMENDATION: Request from M. W. Cude Engineers, for Preliminary Plat Approval for Woodland Oaks Unit 10 (PC #246-95) Steve Simonson advised that this plat is identical to the previous plat. The corrections needed on Unit 10 are the same as Unit 6-A with the exception that the lot sizes are noted. Merwin Willman commented that the utilities will be in the back of the lots. Steve Simonson mentioned that is where they are now so in following in the same pattern they will be in the back. Pia Jarman asked on lot 45 staying NS (Neighborhood Services) will there need to be a non access easement on the FM 3009 Side. Steve Simonson advised to make this a viable commercial lot it has to have the ability to have access to Dimrock and FM 3009. This will have a 25' building set back as it will back up to a residential area. Merwin Willman mentioned that awhile back it was the intent to keep as many entrances and exits off of FM 3009 as possible. Ernie Evans commented it is showing the easement coming around the back of lot 48 to lot 47. There is a question on how they will provide the services for lot 46. Steve Simonson explained if you look below lot 47 there is an already existing utility easement running in the area to the lots. -7- In lot 45 the arrows and dashes that go to FM 3009, should be the existing power supply. Mike Cude confirmed that is the existing main power line off of FM 3009. Tony Moreno moved to approve the request from M. W. Cude, Engineers, for the preliminary plat approval for Woodland Oaks Unit 10 with the corrections as discussed. Merwin Willman seconded the motion which carried as follows: AYES: Tony Moreno, Merwin Willman NAYS: Pia Jarman, Ernie Evans, Keith Van Dine The motion did not pass so the request from M. W. Cude, Engineers, for the preliminary plat approval for Woodland Oaks Unit 10 was disapproved. Steve Simonson asked if the Commission would accept the corrected preliminary plat and final plat on the same night. The Commission was in agreement with the preliminary plat and final plat submission for the same night. #16 CONSIDER AND TAKE APPROPRIATE ACTION: Request from M. W. Cude, Engineers, for the New Master Plan for Woodland Oaks Units 5 & 6 (PC #244-95) Steve Simonson stated in discussing all the ramifications that are minor, Mr. Cude and he felt the need to change the street location that will connect with Ashley Place. There are some minor modifications on how the lots would be laid out from the original Master Plan. It was requested a new master plan with all of the changes be submitted for the Commission to review for approval. Merwin Willman asked why the master plan was not showing Unit 5-A & B? Steve Simonson stated that the master plan is of the entire subdivision and on master plans we do not show the subdivisions broken up into units. Mike Cude showed the Commission a colored drawing of the entire Master Plan for their review. Ernie Evans questioned the drainage ditch being changed on the Master Plan to show where it should be across the park just below Cotton King. Steve Simonson stated it is showing the proposed 10' drainage ROW on the Master Plan. Ernie Evans asked for a corrected Master Plan labeling the different areas so they are clearly identified. Ernie Evans moved to approve the request from M. W. Cude Engineers, for the new Master Plan for Woodland Oaks Units 5 & 6. Tony Moreno seconded the motion which carried with a unanimous vote. -g- #17 DISCUSSION: UDC REVIEW (TIME PERMITTING) Due to the numerous agenda items covered the UDC was not discussed. X18 GENERAL DISCUSSION: Tony Moreno Tony Moreno stated he had no comments. Keith Van Dine• Keith Van Dine apologized for being late this evening due to work related problems. He is working on the problem and will hope in the future to be on time. Ernie Evans• Ernie Evans thanked everyone for their kindness for the flowers received on behalf of his father-in-law. Ernie Evans asked Steve Simonson if all the digging and construction on Schertz Parkway had to do with the telephone upgrading. Steve Simonson stated that was correct. It is the fiberoptic cable. Pia Jarman• Pia Jarman mentioned that Bob Andrews is having a very hard time and asked everyone to remember Bob and Joyce in their prayers. Tony Moreno stated he had called Bob a few days ago and Bob sounded very weak. Steve Simonson stated that Bob has a bleeding ulcer and he is receiving blood transfusion every week. Keith Van Dine asked if they were in need of any donors for blood. Steve Simonson advised that Bob and Joyce have been told if they are in need of any blood to let us know. Merwin Willman: Merwin Willman stated he had no comments. Councilman Ken Greenwald: Councilman Ken Greenwald stated that the City Council passed the recommendation for the increase in the schedule of fees. The recycled paper had to be thrown out due to the rain storm. You can not recycle wet paper. Councilman Ken Greenwald mentioned the Christmas Committee is in need of volunteers, if anyone is interested. There will be a meeting Thursday August 10, at 4:00 p.m. They meet once a month and it is slot of fun. -9- Steve Simonson: Steve Simonson apologized for the preliminary plats of Woodland Oaks Units 6-A and 10. It was intended as a learning experience. There are times when the Commission does not see plats that need alot of corrections. Steve Simonson reminded everyone that will be attending the Texas APA Conference in October to please let Denise know their plans so the reservations can be made as soon as possible. Steve Simonson mentioned there are alot of constructions going on at this time in the City. You will notice with the Vestal Steel Subdivision revised plat. This was a request from the owner so he could expand their land for companies that are looking at expanding out into the area. There looks to be more industrial and manufacturing companies wanting to expand into this area within the next 2 years and the area will be extremely fast growing. Councilman Ken Greenwald mentioned the City Council will be starting the 1st budget session tomorrow night. There will be five or six sessions. There is a .02 cent preliminary tax cut. With all the single family home improvements, the City can not depend on that, it also needs the businesses. Merwin Willman commented that back in 1986-87 there was a big tax reduction with the City borrowing money to live. Steve Simonson mentioned that GVEC will be having a meeting on the new power main substation on Wiederstein Road at the Knights of Columbus Hall from 4:00 p.m to 7:00 p.m. tomorrow night. This meeting is open to the public for any questions anyone may have. Merwin Willman asked about the poles in cement on Elbel and FM 3009. Steve Simonson stated he was in contact with TXDOT, the poles are going to be used for the "walk" and "don't walk" push button signs for people to be able to cross FM 3009 and Elbel. Keith Van Dine mentioned that the teen rehab has lost their financing. #19 ADJOURNMENT: Keith Van Dine moved to adjourn the meeting.
