MINUTES OF WORKSHOP JUNE 1, 2017
I. Call to Order and Establish a Quorum.
Mayor Carpenter called the workshop to order at 6:35 PM.
Members present were:

II. Introduction
Mayor Carpenter welcomed everyone who was present.
Mayor Carpenter moved to Item IV on the agenda.
IV. Items of Interest by the Member Cities.
Mayor Carpenter recognized Mayor Pierce who spoke about the opening of their new
expanded animal shelter in partnership with Bexar County. It went very well and they are
glad to have it. In answer to a question about citizen concerns of noise and other issues,
she said those were recognized and subsequently addressed with the nearby residents.
Mayor Carpenter recognized Mayor Daly who spoke about a recent convention he attended
in Las Vegas offering an opportunity for municipal officials to talk to businesses about
bringing them into their cities. It was huge. They had every kind of business there and
even companies who would assist you in how to attract businesses to your city.
6:40p. m. -- Ms. Catarina Gonzales called via conference call so Mayor Carpenter moved
to Agenda Item IIL
III. OLD BUSINESS:
1. Wrap regarding the 85th Texas Legislature. (Catarina Gonzales)
Mayor Carpenter connected via speaker phone with Ms. Catarina Gonzales who
updated the group on the results of the legislature regarding the following bills:
SB 2 – did not pass. Also, the property tax transparency provisions that Rep.
Bonnen added to SB 669 did not pass. Note: she thinks this could return if a special
session is called by the governor.
SB 715 – annexation bill – did not pass due to filibuster by Senator Menendez.
SB 1004 – small cell deployment. Did pass —the house version. She will provide
a more detailed analysis later. Still limits the fees you can collect for right of ways.
She thinks TML will be consulting with cities as to whether they should sue or not
because the constitution says you should get fair market value for use of right of
ways.
HB 100 – did pass. Pre -empts city ordinances for companies like Uber and Lyft.
They are back in Austin and Lyft came back to Houston.
SB 4 – did pass – very bad for cities (ref. civil liability for elected officials). Several
cities are already suing (San Antonio, Austin, El Paso County, Maverick County).
SB 1248 – did pass – limits city authority over manufactured homes in designated
manufactured home parks but does not limit zoning of such homes.
HB 1111– did pass. Allows general law cities to regulate sex offender residency.
SB 1440 – did pass – allows city officials to attend candidate forums without
triggering open meetings posting rules.
SB 1620 – the chicken bill failed.
SB 451– did not pass. Would have pre - empted cities on short term property rentals.
SB 88/HB 808 – did not pass – would have banned red light cameras.
SB 103 – would have banned city plastic bag ordinances – did not pass.
SB 1172 – amendment to preempt most city ordinances failed. Would have affected
situations where permitting is required on certain businesses (i.e., sex shops).
Ms. Gonzales stated that there is usually a 20% passage of bills. So, like for 6,000
bills, that would mean about 1,200 4,500 bills would pass during the session. So
far only 824 bills have passed, which is historically very low. She expects a special
legislative session to happen – the governor is already openly talking about it and
it would include property taxes and the sunset issue.
Mayor Carpenter returned to Item IV of the Agenda.
IV. Items of Interest by the Member Cities. (continued)''
Mayor Carpenter mentioned that the City of Cibolo has now removed the City of Schertz
from all of their legal documerit(s) regarding their toll road project. The resolution Schertz
passed on April 181h earlier this year didn't imply or state that we did not support the toll
road; it simply stated that Cibolo has a right to pursue infrastructure projects `within their
own city limits.'
Mayor Pierce stated that on July 4th they are having fireworks in the park. A celebration
will be held from 2 -10 p.m. and fireworks at 9:15 p.m.
Mayor Milanovich announced that `Brietzke's Station' (a former popular restaurant) in the
City of New Berlin will be reopening soon under new management.
V. Establish a Date, Time, & Location of the Next Meeting. (Next up is the City of
Marion to host for July 6, 2017.
Discussion occurred regarding the summer NEP meetings of the workshops and the regular
meetings. The decision was made to have neither the workshop nor the regular meeting
during the month of July. Mayor Carpenter made the motion, Mayor Daly seconded it and
everyone present agreed.
VI. Review and discussion regarding the Agenda for June 8, 2017, regular meeting.
No changes were made.
VII. Adjournment.
As there was no further business Mayor Carpenter adjourned the workshop at 7:09 p.m.
