GENERAL INFORMATION Section 395.058 (c) (4) of the Texas Local Government Code requires the Capital Improvements Advisory Committee (CIAC) to file semi - annual reports with respect to the progress of the capital improvement plan and report to City Council any perceived inequities in implementing the plan or imposing impact fees. Section 90 -158 of the City's Code of Ordinances includes the same requirement. Active projects and associated expenses that are funded using Impact Fee Funds this period were as follows: Water • Corbett Ground Storage Tank • Expenses FY22: Professional services - $114,254.48 • Status: 100% Design plans, specifications, and bid documents complete and delivered to City. The applicant is proposing to amend the Comprehensive Land Use Plan by changing approximately 22 acres of the Future Land Use Map from the Agricultural Conservation land use designation to the Multi- Family Residential land use designation. The Future Land Use Map for the subject area was evaluated as part of the Sector Plan Amendment to the Comprehensive Land Use Plan, adopted by City Council on July 16, 2013. The subject properties are currently designated under the Agricultural Conservation land use designation. The Agricultural Conservation land use designation is intended to preserve Schertz in a rural /agricultural state. Some of the character defining elements of Agricultural Conservation are mainly large -lot residential and agricultural uses with some agricultural related commercial uses being permitted (landscaping business, metal workshop, farmers market, convenience store, etc..., with appropriate design and transition standards). The applicant is proposing to change the Future Land Use designation of the subject properties to Multi - Family Residential. This proposed Future Land Use designation is intended to allow Apartment buildings and developments with three or more units as well as nursing homes and assisted -care group living facilities. STAFF ANALYSIS AND RECOMMENDATION: The 2013 Sector Plan Amendment of the Comprehensive Land Use Plan sought to establish future development of the North Schertz area to have a mixture of commercial, light industrial, mixed use and rural conservation, which would allow for smart growth as the City continues to grow and develop. In looking at the Future Land Use Map, it roughly outlines the future land use designations intended for the North Schertz area. The North Schertz area was identified to have a majority of Interstate Highway 35 to be Commercial Campus and Highway Commercial, to having Industrial and Mixed Use Neighborhood from Lookout Road to FM 3009, and then having Agricultural Conservation from mid -block of FM 2252 to Schwab Road. The growth of North Schertz has seen that the retail, restaurants, grocery, and convenience stores have developed along the IH -35 area as well as FM 3009. The area from Lookout Road, Tri- County, and abutting a portion of FM 3009 has seen the development of Industrial businesses. There has also been growth between FM 2252 and Schwab Road with smaller light industrial /commercial businesses, schools, and large acre residential tracts. Beginning from the mid -block of 35 heading north towards FM 482 and beyond has the land use designation of Agricultural Conservation. Given that a vast amount of the properties along FM 482 are large residential lots, light industrial/ commercial businesses the current land use designation of Agricultural Conservation is most appropriate for this area. The subject properties are located within the Agricultural Conservation land use designation, which plays an important role in preserving the rural character of Schertz. Staff understands that it is important to consistently update the Comprehensive Land Use Plan in order to have goals that are both beneficial to our residents and feasible given the current market. However, staff does not feel comfortable modifying the Comprehensive Land Use Plan from the Agricultural Conservation land use designation to Multi- Family Residential land use designation for this area as it would begin to set a trend in allowing higher density development in an area that is not currently developed for dense developments. The area would need to be evaluated for sewer infrastructure as the subject properties are being serviced by on -site septic sewage facilities and are not on public sewer. In addition, the area would need to evaluated in relation to infrastructure for public utilities such as sewer, water, drainage, and roadway infrastructure. This potential amendment to the Comprehensive Plan would create issues for the City has it would have to evaluate the current infrastructure for public utilities, which would include reviewing the current capacity for sewer, drainage, and roadway infrastructure. Therefore, Staff is recommending denial of the proposed Comprehensive Land Use Plan amendment due to its incompatibility with the goals and objectives of the 2013 Sector Plan, and the current and surroundiniz land uses.
