GENERAL INFORMATION: Owner: City of Schertz Applicant: Cibolo Creek Municipal Authority, Brandon Bradley Engineer: Plummer Associates, INC., Juvencio Zamora ITEM SUMMARY: The applicant is proposing to preliminary plat the subject property into one commercial lot. The property is currently being used as a Schertz Lift Station and is zoned Public Use District (PUB). The applicant has requested a waiver to UDC Section 21.14.1.x, for the requirement to improve substandard roadways adjacent to proposed subdivision plats. GENERAL LOCATION AND SITE DESCRIPTION: The subject property is located 3,100 feet south of the intersection of FM 78 and River Road. PUBLIC IMPROVEMENTS: The applicant is seeking approval of a waiver regarding the requirement to improve the substandard roadways adjacent to the proposed subdivision plat. The proposed Schertz Wastewater Lift Station subdivision is along Bubbling Springs Road and would be required to reconstruct one half of Bubbling Springs Road along their frontage, approximately 667 feet, as the current roadway does not meet the minimum local street standards as set forth in the Unified Development Code, the Design Guide and the Comprehensive Land Use Plan. However, the construction of the street improvements must also be "roughly proportional" as per State Law. The Schertz Engineering Department performed a rough proportionality analysis of the proposed development and identified the following: • The property is zoned Public Use (sanitary sewer lift station). There would be no change in use as it is currently being used as sanitary sewer lift station and will continue the same use but will be relocating the facility. There will be no additional traffic demand by the proposed development. • Bubbling Springs Road improvements would normally include widening the street to the developments half of the street equal to the minimum section for a local street. In the case of this plat, widening would amount to approximately half of a lane width. The proposed development has 667 feet of roadway frontage. Based on the analysis that the Engineering staff completed, the construction of the street improvements would not be "roughly proportional" to the proposed subdivision's impact to the transportation system. Therefore, in order to comply with the State Law requirements, the construction of the street improvements should not be required for the proposed Schertz Wastewater Lift Station subdivision. Although the street improvements should not be required, the proposed preliminary plat associated with this waiver is providing right of way dedication in the amount of 0.921 acres or 50 feet in width adjacent to the lot. STAFF ANALYSIS AND RECOMMENDATION: In order to not require the construction of these improvements, a waiver from the requirements set forth in UDC Section 21.14. LK must be requested as Staff can not administratively waive construction of street improvements. Based on the Engineering Departments review of the rough proportionality it was determined that requiring the applicant to construct half of the roadway of Bubbling Springs would not be 'roughly proportional' to the proposed subdivision impact to the transportation system. Therefore, Staff recommends approval of the waiver to not construct adjacent street improvements for the proposed Schertz Wastewater Lift Station Subdivision. * While the Commission can impose conditions; conditions should only be imposed to meet requirements of the UDC. COMMISSIONERS CRITERIA FOR CONSIDERATION: Sec. 21.12.1.5. - Waivers. A. General. The Planning and Zoning Commission may authorize waivers from the provisions of this Article when, in its opinion, undue hardship will result from requiring strict compliance. In granting a waiver, the Planning and Zoning Commission shall prescribe only conditions that it deems necessary or desirable to the public interest. In making their findings, the Planning and Zoning Commission shall take into account the nature of the proposed use of the land involved and existing uses of land in the vicinity, the number of persons who will reside or work in the proposed subdivision, and the probable effect of such waivers upon traffic conditions and upon the public health, safety, convenience, and welfare in the vicinity. Waivers shall not be granted unless the Planning and Zoning Commission finds: 1. That the granting of the waiver will not be detrimental to the public health, safety, or welfare, or injurious to other property in the area; and 2. That the granting of the waiver will not have the effect of preventing the orderly subdivision of other land in the area in accordance with the provisions of this UDC. Such findings of the Planning and Zoning Commission, together with the specified facts upon which such findings are based, shall be incorporated into the official minutes of the Planning and Zoning Commission meeting at which such waiver is granted. Waivers may be granted only when in harmony with the general purpose and intent of this UDC so that the public health, safety, and welfare may be secured and justice done. B. The Planning and Zoning Commission may establish a time period for execution of each granted waiver. C. Such findings together with the specific facts on which such findings are based shall be incorporated into the official minutes of the Planning and Zoning Commission meeting at which such exception is granted. D. Planning and zoning commission shall not authorize a waiver that would constitute a violation of a valid law, ordinance, code or regulation of the City. E. Any decision of the Planning and Zoning Commission regarding waivers to the provisions of this Article may be appealed to the City Council. When considering an appeal, the City Council shall consider the same standards as the Planning and Zoning Commission as outlined above. As seen in the preliminary plat (attached), Plummer is providing the right -of -way dedication in line with Unified Development Code requirements. However, proposed construction of the cul -de -sac is not included in the scope of work for the Lift Station. Proposed roadway improvements extending to the southmost boundary line of the platted tract (Lot 1, Block 1) are also not being proposed for the following reasons; • Right -of -way access is being fulfilled for the remaining portion of the parent tract and adjacent properties with the dedication as shown in plat; • Proposed site improvements do not require the extension of an access road further south than shown; and • Further extension of the access road southbound would encroach into designated FEMA Floodway. As intended with the Site Plan, Driveway 2 serves as the main turnaround approach. Through the use of vehicle analysis software, Driveway 2 with the extension should allow up to a 75 LF vehicle adequate room to maneuver a turnaround. For these reasons, a waiver is requested for the proposed "alternative hammerhead" turnaround at driveway 2 to serve as the main turnaround approach. The proposed CCMA Schertz Lift Station Subdivision (on Bubbling Springs Road approximately 3,100 feet south of FM 78) would be required to reconstruct one half of Bubbling Springs Road along their frontage as the current roadway does not meet the minimum local street standards identified in the Unified Development Code, the Design Guide, and the Comprehensive Land Use Plan. However, construction of such street improvements must also be "roughly proportional" as per State Law. Staff has performed a rough proportionality analysis of the proposed development: - Development use: Public Utility (sanitary sewer lift station). This site currently has a sanitary sewer lift station on it. The proposed development will replace the existing sanitary sewer lift station with a new sanitary sewer lift station. As there is not real change in use, there would not be any increase in traffic as a result of the proposed development. Therefore, the additional traffic demand by the proposed development is zero. - Bubbling Springs Road improvements: normally would be required to widen the street so the "development's half" of the street equals the minimum section for a local street. In this case, the widening would equate to approximately % of a lane width. The proposed development has 667 feet of roadway frontage. Constructing approximately %2 of a lane for this distance would create some amount of additional vehicle miles of capacity.
