GENERAL INFORMATION: Owner: Amin Hemani, TEG Schertz Ventures, LLC Applicant: Chris Orem, KFW Engineering APPLICATION SUBMITTAL DATE: Date: Application Submittal Type: June 3, 2022 Final Plat Application ITEM SUMMARY: The applicant is requesting to final plat approximately 1.7 acres of land in order to establish one commerciallot. GENERAL LOCATION AND SITE DESCRIPTION: The subject property is a vacant piece of property, currently zoned General Business District (GB), located at the southwest corner of Schaefer Road and FM 1518. The subject property abuts the Willow Grove Estates Subdivision. ACCESS AND CIRCULATION: The proposed Willow Grove Estates Commercial plat will have two points of access. The first access point will be from Schaefer Road and the second access point will be Brook Orchard. TxDOT has indicated that no access onto FM 1518 will be permitted as there are too many drive approaches in the area and not enough spacing to separate an additional driveway. Therefore, the plat has a one (F) foot non - access easement along the front of the property adjacent to FM 1518. TREE MITIGATION AND PRESERVATION: The applicant will be responsible for complying with Unified Development Code (UDC), Section 21.9.9 Tree Preservation and Mitigation. They have submitted a signed tree affidavit indicating the subject property has no Protected or Heritage class trees. Therefore, the applicant will have no tree mitigation fees to be paid for the Willow Grove Estates Commercial Subdivision Plat. PUBLIC SERVICES: The site will be serviced by the City of Schertz for water and sewer, CCMA, CPS, AT &T, and Spectrum. PUBLIC IMPROVEMENTS: All public improvements required for this subdivision are required to be installed prior to recording of the final plat per UDC, Section 21.4.15., unless otherwise specified in an approved development agreement. Water: The property will be serviced by the City of Schertz through an 8ineh water line. Sewer: The property will have sewer through an flinch line. It will be collected by the City of Schertz, and treated by Cibolo Creek Municipal Authority (CCMA). Drainage: The applicant is responsible for all drainage associated with the subject property, and for compliance with the Stormwater regulations. A Stormwater Management Plan has been reviewed and approved by the City Engineer. Sidewalks, Hike and Bike Trails: A sidewalk will be required to be constructed along the frontage of the property that abuts FM 1518 and Schaefer Road. There is an existing sidewalk on Brook Orchard. The construction of the sidewalk will need to meet the City of Schertz specifications. Road Improvements: The property is located on FM 1518, which per the Master Thoroughfare Plan is classified as a Principal Arterial (120'- 130' ROW). However, TXDoT has previously acquired the necessary right of way dedication. No dedication or improvements are proposed along FM 1518. The property is also adjacent to W. Schaefer Road, which per the Master Thoroughfare Plan is classified as a Residential Collector (70' ROW). The proposed final plat is dedicating 10 feet of right of way along the property frontage adjacent to W. Schaefer Road. COMMISSIONERS CRITERIA. FOR CONSIDERATION: The Planning and Zoning Commission is the final approval authority of the proposed final plat. The objective of the Single - Family Residential land use designation is to have a mixture of residential uses and limited commercial development. • Comprehensive Plan Goals and Objectives: Areas classified as the Single - Family Residential land use designation are intended to utilize a traditional neighborhood design that includes a mixture of residential uses, as well as limited commercial development to support the daily activities of the development. The proposed zone change meets the goals and objectives of the Single - Family Residential future land use designations, and is therefore in conformance with the Comprehensive Land Use Plan. • Impact of Infrastructure: The subject properties have dual Certificate of Convenience and Necessity (CCN), specifically the City of Schertz and Green Valley Special Utility District. The portions of the subject tract that are within the City of Schertz CCN will be obligated to design water and sanitary sewer services throughout the subdivision during the Master Development Plan Process in order to connect to public utility systems. Right -of -way dedication will be required from the proposed development as identified on the Master Thoroughfare Plan, i.e. Trainer Hale (secondary arterial) and the North & South Connector as a planned residential collector. • Impact of Public Facilities /Services: In accordance with the Texas Local Government (LGC) Chapter 43, the City must provide public services to the land on the effective date of the annexation. • Compatibility with Existing and Potential Adjacent Land Uses: The surrounding properties to the subject property are all currently being used for single - family residences, agricultural uses, or are undeveloped. The proposed zone change to PDD, given the single - family residential base zoning throughout the entire subdivision is compatible with the existing and potential adjacent land uses. STAFF ANALYSIS AND RECOMMENDATION: The property has the land use designation under the Schertz Sector Plan for Southern Schertz as Single- Family Residential. The Single - Family Residential land use designation encourages the development of traditional neighborhood design that includes a mixture of residential uses, as well as limited commercial development to support the daily activities of the development. The proposed rezoning to Planned Development District does conform with the Comprehensive Land Use Plan designation. The Sterling Grove Subdivision is providing curvilinear streets, mailbox bump outs with a cover and 2 parking spaces, an amenity center, approximately 3 acres of park, approximately 22 acres of drainage basins, approximately 27 acres of floodplain, open space and city trail system, approximately 15.5 acres of open space, and several drainage easements throughout the development. The applicant is actively working with the Parks Department on finalizing details on the proposed park land, which at this time has not been determined to be public or private. The proposed development will be providing six hundred seventy -two (672) of the proposed 'SF 55' lots and one hundred sixty (160) 0.5 acre lots. The median lot size will not meet 7,600 square footage as discussed in the subcommittee meetings as the overall lot size will be 6,050sgft. Approximately 20% of the proposed development will be in accordance with the 0.5 acre lot size. In staff communication with the developer, it was indicated that there is a desire from the developers' perspective to have the proposed 160 lots that are the 0.5 acre lot size to not connect to sanitary sewer and utilize an on site sewage facility. Although based on conversations with the City's legal team this type of request could not be approved as part of the Planning Development District narrative, staff is requesting that the Planning and Zoning Commission clearly identify if the zone change to PDD were approved, if the Commission would be supportive of approving waivers during the platting process for the 160 lots to allow them to not connect and to utilize on site sewage facilities. This clarification from the Commission is necessary information for the applicant moving forward. Given the uniqueness of the development, open space /trail system and the mix of lot size, including approximately 20% being the 0.5 acre lot size, staff is recommending approval of the Sterling Grove Subdivision Planned * While the Commission can impose conditions; conditions should only be imposed to meet requirements of the UDC.
